Evey State has it's own requirements and most Beneficiaries are taking their Passport as ID to get a Marriage Lisence. Though, like others have said, some did have problems getting one due to not having a SSN.

If he can use his Passport without a SSN, you can get married in the same week if you wanted to. Although you have set up a date already.

Hey everyone! Hope you are well!! Bahadir and i have set November 19th as our wedding date. Our interview date is October 27th and he is going to fly here the day after he receives his Visa. We are guessing he will get his visa and be here by the 8th. FINGERSCROSSED....but do we have to wait a certain time before we can get a marriage license?

It all depends in what state you are and/or what state do you want to marry. Normally, people marry where they reside, but that is not mandatory. That said, in some states there is blood tests, waiting periods, need SSN, etc; and in others none of that. In fact, in some states, you do not even need anyone to solemnize your marriage, you can do it yourselves!

I just want to add here that a K-1 CAN get a SSN after marriage as long as there is at least 2 weeks left on the I-94. Some SSA employees get confused and think that somehow the person is now a K-3 but that is obviously wrong.

I have not yet found a single state that requires SSN for marriage by law, though a lot of country websites in those states claim they do. If you read the actually statute is says (in every state I have researched) that if one party does not have a SSN then they will sign an affidavit stating they don't have it and the marriage license will be issued.

You can apply for the SSN the first day he arrives, but he might not be in the system yet. It is advised to wait 10-14 days after entry to apply for the SSN. As said above, you can get your SSN even if already married, so long as you have at least 2 weeks left on your I-94. Since you are getting married quickly after arrival, that should not be a problem for you at all. Print out and take the rules for a K-1 along with you to the SSA. If they try and tell you he cannot get his SSN because he is married, show them he is allowed using their own rules. Ask to speak to a supervisor if you must. You might even get lucky and get someone that doesn't give you a hard time. Good luck!

It's Victor from Russia writing. You don't have to wait 2 weeks and can marry as soon as allow laws of your state. But from main Russian fiance(ee)s forum I read a lot of advices to get SSN first. Some fiance(ee)s got problem with getting SSN after wedding, because they K-1 visa doesn't work after marriage, but they still haven't GC for a some months, so in many SSN offices clerks refusing to give SSN card after marriage and till getting Green Card by reason that your fiancee is legally in US, but "out of status" while AOS petition is pending (what can be long in some cases, especially if your fiancee will be choosed for "NameCheck"). So by opinion of Russian fiance(ee)s forum it's good decision - don't run to get marriage license right from POE, apply for SSN card first.

Or you can go to the SSA and get the SSN and not mention you are married. That is what we did as Roza is keeping her maiden name at least until citizenship and maybe forever. We applied but did not mention we were married so it was not an issue.
