Approved...and some questions...

Well, I wasn't sure whether or not to post this at first, but I figure that it's good to let people know what's going on at CSC, even if it does seem blatantly unfair.

Gary and I were approved through the CSC yesterday, Sept. 15th, I just got the email. We filed on July 11th, so 72 days according to the VJ timeline. No RFEs, and only one touch on 7/25. We're excited, but I think at this point more in shock than anything. We're also a little nervous because he is planning to come for Thanksgiving in November, but our wedding date is not until May, so unbelievably this happened a bit too quickly for us (I'm sorry, I'm sure it's very hard for some of you to hear that).

So, two questions:

-Will the approved I-129f make it any harder for him at immigration than it would otherwise have been?

-Should we explain to the embassy that he is putting off his interview until after he returns in December, or just delay sending in the material? Or both?

Again, I'm sorry if this is frustrating for those of you who have been waiting much longer than we have, and I know there are plenty of you who would kill to have our "problem," all I can say is I hope that you all receive your approvals soon, and I hope our approval signals that the CSC is finally getting in gear!

Congratualtions! It's good to know that there is some action at CSC. It's not YOUR fault that they seem to pick files in a random fashion.

I think this is wonderful news...PERIOD!!! CONGRATULATIONS!!! I'm always glad to see ANYONE getting approved out of CSC. And it isn't up to you who gets processed first. We should celebrate any good news that comes. I'm excited for you!! There's not reason for you to feel shy about telling the rest of us or guilty for your announcement. Bask in the moment. You need to do that!! :D

May the next steps be as trouble-free and as quick as this one was!!

January 2004: Met Laurent at the Bibliothèque nationale in Paris

February 2004: We became an actual couple

January 29th, 2006: I left France to return to the United States--AWFUL to say goodbye!

June 2006: Finally convinced Laurent that a K-1 visa would be more time-effective than trying to get an H-1

August 1st, 2006: The K-1 petition is finally in the mail and on its way to Nebraska...WooHoooo!! And yes, I remembered to attach the check! :-)

August 3rd, 2006: USPS online tracking shows that my petition (sent certified) was received at the NSC at 5:05am

August 14th, 2006: NOA1 received USPS!! (I-129F recv'd at CSC: 8/4; NOA date: 8/10; last touched: 8/11)

October 2nd, 2006: I MISTAKENLY thought we had an approval...False alarm...Back to waiting...

October 3rd, 2006: TOUCHED!!

October 4th, 2006: REALLY AND TRULY APPROVED!!! Email notification lists 10/3 as the NOA2 date.

Later that same day: TOUCHED...AGAIN! Hope that means I'm in a cozy box and moving to NVC this week...

October 10th, 2006: Received official NOA2 via snail mail.

October 19th, 2006: Case received at NVC!! AWESOME!!

October 20th, 2006: Case forwarded to Paris!! DHL says two shipments were headed that way. Must be in there somewhere...

October 27th, 2006: Received official receipt letter from NVC via USPS.

-Should we explain to the embassy that he is putting off his interview until after he returns in December, or just delay sending in the material? Or both?

1. I'm gonna to have to lean towards yes, as your fiance is clearly intending to immigrate to the US. I would humbly advise him to gather as much proof that he still has ties to whatever country he's from (it's not immediately clear to me where he is from) -- perhaps an appointment letter from the embassy??? ;)

2. It depends on how quickly the consulate/embassy you are dealing with is currently scheduling appointments. If they're taking their time, I'd send in the packet three info when you can. if they seem to be quick on the draw, hold off on sending back the info they need, they won't schedule your appointment until they receive what they need.

Thanks for the advice :-) He's from the UK, so it looks like we're talking about 8 weeks after they receive the packet from the NVC. I'm hoping that it will be clear that he is *not* planning to come in illegally, as why bother when we're so close, but definitely a good idea to have lots and lots and lots of evidence :-)

Don't forget that once the visa is issued you have 6 months (or is it 4? someone will correct me?) before you must enter the US and 90 days before the marriage must take place.

I am glad CSC processed you in the time they did. It gives those of us who have just submitted hope the process is moving back to mornal speed. It's good news! :dance::dance::dance:

Congratulations to both of you!

Hearing about a 72 day turnaround from CSC is wonderful for us, and I think to everyone else with a petition there! I hope we get closer to your 72 days than the 6 months we fear.

As to your questions, your fiancé is from the UK. I assume he will be making the visit in November on the visa waiver program? The I-94 form used doesn't ask for any information about any pending visa petition. It seems to me that it is irrelevant, and it wont even it come up when he is going through the immigration line. He visits on the visa waver program, goes back home and continues the process for the K-1 visa. Perfectly legal, no question.

Having back up paperwork may not be all that necessary. Check it out further.

It would be nice if Joy visit so easily. The wait to interview for a tourist visa is 5 months at the US embassy in New Delhi. ~Asha

13 January 07 - "Visa in hand!!"

02 March 07 - Joy "I Do!" Judge "what about you?" Asha "Me Too!" Judge "OK then, you're married!!"

21 June 07 - "application transferred to CSC, Yippie!"

07 July 07 - "why yes, that is a conditional Permanent Resident card in my hand!"
