I am sorry that this is happening to you. Looking at your timeline I am not sure there is anything you can do. The only thing I can advice is moving to Morocco, living with him for 6 months and then doing DCF. Good luck!

I understand your frustration, but put things in order. They did not give your spouse an RFE at the interview in Casablanca, they either put your case in AP or they issued a 221G. Now, you personally interview your husband and have him write down verbatum everything asked and his answers exactly while it is fresh in his mind. With time important facts can be lost. Do research about any possible red flags, age differences or religion, or previous marriages and divorces etc. Stay focused and gather more evidence that would stand up in any court(only an analogy). Take a breath while you wait for your case to be returned to USCIS. Once received, a congressional representative can contact the congressional unit at USCIS for further assistance. I know that this is a hard blow as I have been there. It is not the quantity but quality of evidence that they look at. As others have suggested, if you can, spend more time in Morocco while you wait.

I will say a special prayer for you with Ramadan approaching.

Best wishes.

DCF is direct consular filing. Ie you don't petition for the spousal visa via the lockbox, but directly via the embassy. It is only an option for those who have lived abroad for at least 6 months, and tends to be easy to get a visa that way because the fact that you have lived with your spouse for so long shows the bonafides of the relationship. It is also much faster (see my timeline). But after August 15th, DCF will be severely restricted to only those countries that have USCIS offices locally.

Bye: Penguin

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

first this is my 4 trip and i stay for more than a month each time and i have to hire a nurse to stay at my sons house as he is terminally ill. I own my own home and can not leave it empty not knowing if air conditioning or the heat is working properly: I must protect this investment; Next my husband died in 2007. And age as an issue i resent when old men in Florida are allowed to marry girls who put ads online like they are setlling themselves for visas; I met ùy husband honestly and we spent 9,months getting to know each other before i made the trip to meet him and his falily; I have the required income; the house; own my cars outright.Ours is not fraud. I also have a lawyer who tells me to go to embassy every day but the place to check says no one there can help: and my congressman already wrote but embassy says they have these requests all the time and they mean nothing! I explained all this. i need real help; we wrote down all questions and as Adil could remember and he answered all; I am also muslim. I went to Islam 2 months before meeting Adil: after our meeting this is one of the things we talked so much about as he helped me with my new faith

Essentially, what you are saying is that your home and son are more important to you than spending significant time with your husband. It's not that you "can't". It's that you have more important things to do. This is your choice but you must recognize it IS a CHOICE, or a WILL NOT not a CANNOT.

Obtaining an immigrant visa for a spouse certainly requires that you jump through the hoops, pay the fees and be financially qualified to sponsor but the decision about whether the relationship is bona fide is, one, fairly subjective and IS made by a Consular officer and two, is not really about how genuine the US Citizen considers their relationship to be. It's about what the Consular Officer believes about the sincerity of the foreign spouse. In making these decisions, they are trained professionals considering the totality of the circumstances. Some of those considerations are not known to or considered by the petitioner.

The strongest possible evidence of a bona fide relationship is, has been and will be the time the couple spends together as husband and wife. Your difficulties are certainly part of the totality of circumstances and will be considered but it is a judgment call as to HOW they will be considered.

I agree with PUSHBRK but i know that the decesion is biased to a certain point based upon other cases that the adjudicator has handled previously. Unfortunaly, Morocco has a poor reputation for high fraud. Although, I do not feel that PUSHBRK is correct in their explanation of choices. How can a mother choose between her children and husband. If one has small children or at least under the age of 18, one must understand international custody laws. It all all about presentation to the consulate, the appearance of your case and the readiness of the beneficiary. Moroccan nationals have more challenges than we have here in the US. Even internet and phone service is unreliable. I feel that we ALL make tremendous sacrifices. My husband does manual work 12-14 hours six days a week with no fair labor laws enforced. He is online with me daily at night, sometimes only getting 3-5 hours a sleep a night. He reads bedtimes stories to my kids almost every night on Skype. His internet service costs are twice what I pay here. He also is financially responsible for his parents who have serious medical conditions. My husband is more than spread thin. OMG whatelse can he do without seriously jeapordizing his health! All of the decesions handed down by the US consulate are not just subjective and some are serious errors in judgement.

Pushbrk never suggested you change your priorities. He, "that's me" suggested that if you wish to be with your husband in the USA, eventually, you'll probably need to spend some significant time living with him abroad first. While it may not be practical to do that now, it may be later. However, you actually ARE choosing between your your child or children and your husband. How you do it, is an individual matter and perhaps different each time. My wife chooses between me and her daughter often and sometimes between me and the dog. I love the dog too but sometimes his needs make mine take the third seat.

Just wanted to add that we all make choices and value judgments every day. It has become a tendency in our society lately to think in terms of, "I have no choice." or "I had no choice", when the fact is, among the available choices we recognized only one choice as acceptable to us. Often our choices uncover our priorities.

Tough call, I have seen a trend on Middle east comments here, getting harder to come to us. Follow attorney advise at this point. Best of luck.

I agree with PUSHBRK..... We filed for the K-1 in 2009, our case was sent back I followed all the advice = Contacted the Conlusate the Senator, blah, blah, blah.... Our case was administrativly closed due to the dates expiring  Since september 2009 I have been to Morocc 3 time the first time 3 weeks the 2nd time 5 weeks and the last time 3 months....I wish I could have stayed longer but I have a minor child and I really am trying to do this without totally uprooting her life... I recently returned home from Morocco and will be filing for the CR-1. God willing everything will work out this time around... If not I guess I will be moving to Morocco...... The whole process concerning Morocco seems to be a ####### shoot.... My husbands brother and sister both came here about 4 years ago within months of one another..... Both married white nonmuslim american (sister's husbands conversion was only to appease their parents) who are from little hick towns.... Where I am african-american, muslim and live about 20 min outside DC..... Oh did I mention that their spouse were previously married to each other  I would really hate to think any type of discrimination played a part here.... And after talking to my husband about his interview there were not "RED FLAGS"..... That had anything to do with us anyway....I'm thinking his brother and sisters situation may have hurt our case but I am not sure.... Anyhoo... I wish I had some good sound advice for you... All I can do is wish you the best and pary you are blessed with good results...
