Hello!

My husband and I just got a RFE for our 751 packet. Since the time of our original filing, our son was born. Obviously, we will include a copy of his birth certificate, photos of us in the hospital, congratulatory cards and messages, letter from the insurance company, etc.

Any other evidence of our shared life together has already been sent in. (Tax returns, joint bank account, utility bills, lease, affidavits, etc.)

My question:

Does it make sense to reference (list) or send in copies of what we already sent in? The RFE lists many things as examples that we have already sent in and because of this, I feel like our RFE packet is fairly "flimsy." However, we simply don't HAVE anything else that hasn't been sent in.

Thoughts?

What exactly did the RFE request? What have you sent already? Without some specifics it is difficult to give good feedback.

I have read many threads on this and know of the types of evidence that show our co-mingled lives. Everything that we have, we've already sent in. We don't have any more joint financial obligations (besides the joint checking) - no joint credit cards, etc. Our utilities are in my name. We don't have any loans. Our lease has already been sent in.

Did you send the copy of the GC. May be send copy of DL etc.

Also send the Birth Certificate.

I am not sure what more you can do about the financial records but how about sending most of the evidence again like your joint checking, tax transcripts etc.

Not meaning to sound like a complete jackazz, but it seems that the submission was found lacking. Whose identity did the RFE need confirmed? One would think that the adjudicating officer is not just waiting on your child's birth certificate to grant approval. There is something giving the IO doubts.

Sharing a scan (with name, case number, etc. redacted) or typing an exact quote can aid members in providing feedback.

i got RFE in the mail last week also.. and we sent everything we had with the first package...,i heard that half of the time they ask for the same things u sent them already..so we made copies of some things we sent them already and some other stuff we got in the mail since we filed ROC and some new things here and there that i dont think were very important along with an explanation letter why we dont have certain things...now im waiting to see whats next..

Were your tax transcripts joint and at least showed a 2 years time laps ? because its weird with that evidence you should have gotten approved already, unless the officer sow some sort of mismatch in your info. Were your tax transcripts all pointing to the same address for both of you ? a mismatch like that could also prompt a RFE because they could think u 2 are not living tougher etc.

Make sure your statements (bank, insurance, whatever) span the 2 years of GC - so couple of them from beginning, middle, end of each year. Send the most current ones as well.
