IRS transcript and unsigned 1040 income tax

i try online its saying we can't find your information.

i call them they put me on hold 20mints. i think its better if i go IRS office to get one.

If you try to request by phone. It will take a while before you can talk to a rep. You can also request a fax or mail it. At first, I requested by mail and after a week, i still get it, so i requested to fax me a copy from work. That day, when i got home, my IRS transcript arrived... hehehe! So, I have a fax and mail copy IRS transcript. Though, I would prefer the mail IRS transcript because it's much more clearer than fax copy...

I am going to just send an employment letter with latest pay stub. You are fine with your pay stubs.

Thanks NavyK. With regarding proof of employment. Should I tell to our Human Resources to add the previous years I work with the company? I started working at our company from June, 1996 to Jan, 2000, I resigned, then rehired again on Oct 2000 to Present... Here is the bottom line - NVC is looking into the fact that we can support our spouses after the spouse enters US. So don't bother too much about the past employment. You have current employment and latest pay stubs - that should do. The IRS transcripts also are required for the latest year 2010 and the other two (2008 & 2009) are optional - helps in case you salary for 2010 is on the borderline of the 125% proverty level.

Take for example my case, I was student for 2 years (08/2009 to 05/2011) has good pay in 2009 (7 months) but 2010 is not good as I worked only during summer. Now after graduation I have good pay but just one pay stub. In my case it makes sense to send all 3 years transcripts and an explanation letter for 2010. Hope you got it.

I-864 instructions clearly states 6 months period.

Copied from I-864 Instruction (Part6, #23) - "you may include a recent letter from your employer, showing your employer's address and telephone number, and indicating your annual salary. You may also provide pay stub(s) showing your income for the previous six months."

However I am not sure whether one should send these as the same instructions also states.. "You are not required to submit this evidence, however, unless specifically instructed to do so by a Government official.". But, since it is a good practice to send in some proof for your current salary, I would send it in advance, before anyone requests for it.

in short.. 6 months is legit as per I864 instructions.

Logically NVC should have any issue if you send them last 3 years transcripts. But to be on safe side, sign the 2010 Tax return and send a copy of the full set.

We too didn't sign any of tax returns as those were all filed and signed electronically. So it is perfectly alright to print one copy of 1040 or ....now and send that with I-864 set.

Transcripts are what thay want, always best to give them exactly what they want, this will make your process much faster etc., that way you will meet your goal.

Giving more information is not always going to help. Sometimes it will cause unnecessary RFE to be generated delaying the case.

It is alright to send 6 months of pay stubs if you have those but I don't think it matters when your employment letter states that you are employed with that organization for the last 2 years and you just send one latest pay stub along with such employment letter. What if you started working since 2 months! I thnik we need to use common sense where the instructions are confusing. Of course include all the mandatory ones and try to include the optional ones based on common sense but don't send what is not asked.

Sending paystubs for the last 6 months is pointless. 1 paystub that shows the YTD-Year to Date- how much you made so far this year really is all that you need. Most paystubs have this.

A employment letter I feel is required as it also backs up the paystub and tax info and personally gives a name of your boss/company in which they can contact and get direct info if needed...

Employment letter is mandatory.

Actually, it's not mandatory, it's optional, as are the pay stubs.

From the I-864 instructions, page 7:

"You may include evidence supporting your claim about your expected income for the current year if you believe that submitting this evidence will help you establish ability to maintain sufficient income. You are not required to submit this evidence, however, unless specifically instructed to do so by a Government official. For example, you may include a recent letter from your employer, showing your employer's address and telephone number, and indicating your annual salary. You may also provide pay stub(s) showing your income for the previous six months. If your claimed income includes alimony, child support, dividend or interest income, or income from any other source, you may also include evidence of that income. "

There's only 3 things mandatory in the AOS package: bar-coded cover sheet, I-864 (signed and completed), and tax information (either transcripts OR 1040s and W2s).

And for all joint sponsors, proof of citizenship or residency is required as well.

Back to IRS transcripts. Once I was told on VJ that since I did a joint return, I will have to submit a 1040 form showing my income (not joint).

Unless people file a separate tax return (which of course is not preferred by IO at the time of interview), how are you gonna use a transcript with joint income for your i864 and for the interview?

Not for the purpose of hijacking this thread :no: personally I'm gonna submit 1040 for 2010 (joint return) and tax transcripts for 2008-2009. For i864 processing I will include and submit only 2010 and see if NVC sends me any RFEs. And will keep with me 2008 and 2009 transcripts (just in case if NVC needs it). When it comes to interview, my wife will bring with her either transcripts or 1040 forms for 2008-2010.
