my fiance visa denied

Timeline

my fiance went to intriew US Embassy in Ethiopia and her visa denied. The officer believes we dont have enough evidence to show as we are fiancees.So what do i need to do next? The officer suggested i need go there and get married so if that the case that means i am starting the process all over? The offices also told us they send the application to USCIS that means USCIS is going to contact me? Thanks in advace

Emails, birthday cards, instant messages are others I would try to include. Were your photo's dated? It seems a few VJ'ers are running into the problem of not having dated photo's and getting denied.

I also asked my parents to write (my parents are not high tech and do not have a computer) a letter to my fiance introducing themselves and saying something along the lines of "congratulations on your engagement. We are excited about the wedding and cannot wait to meet our future daughter-in-law". She hasn't had her inteview yet but I am hoping that signed/dated letters from my parents (other family/friends as well) will help show a legitimate relationship. My fiance also has emails from my sister when they were planning the wedding together and she is planning on taking those to the interview as well.

Last year on September, exactly the same thing happened to me at the Embassy of US Addis Ababa. Let me give you this advice, Contact your Senators to find out the exact reason why he is denied. Next get ready to file the next petition. I filed the second one after 4 months of the denial. Now, my fiancée is waiting for the interview at another country. Let me tell you what will happen, the embassy will send it back to USCIS via NVC (I hope already the Embassy sent it in Diplomatic pouch) and mine took 8 weeks to get to the NVC and another 5 weeks to get to USCIS. After the USCIS recieved it, they told me it would take another 120-180 days to review. Eventually I set up appointment at InfoPass and made inquiry on Dec 2 and finally USCIS sent me a letter on Jan 21 telling me the petition was expired and USCIS will not review it and also I am able to file another petition. I filed the second petition on March and approved by USCIS on mid June. Three Senators and one Congressman involved but they couldn’t overturn the decision. Since the embassy denied her visa saying “insufficient evidence showing ongoing relationship”, on this petition I did a “FRONT LOAD” petition with a packet of 3” binder which includes the copy of all the evidences. The packet includes more than 500 pages printout (chat, emails, phone calls, and others), phone cards, gift receipts and a separate album with 105 pic. Take it easy, there is a second chance.

The USCIS will probably sit on the returned petition until it expires. If it reviews your case before it expires and lets you contest the pending denial, then yes you can involve a senator and submit more evidences. Usually it is hard to overcome consular officer's judgment. Like the CO suggested, I would recommend that you go there, get married and file for an immigrant visa. Either way, you probably will have to petition again (considering that the returned petition will expire before review) and therefore IV is more safer than a fiancee visa. Hold on to every evidence you have now and get ready to travel.

The reason that I sent the "Front Load" petition was, the CO didn't even ask my fiancée to present the evidences at the time of the interview. The other thing, I heard mostly the CO make a decision even before they conducted the interview. There are two things you can do to win, be there with your fiancé (e) at the interview or Front load your petition to get your relationship evidences to the embassy via USCIS and NVC. I don't know how long AJ-w has before the validation period of the petition over. As Fazmo said, USCIS will sit on the file until the time is over. When another friend denied his fiancée's visa, there were 65 days left on the petition, but USCIS slept on those days and sent him a letter on the 5th day from the expiration date. For USCIS and DOS that is one of the ways they figure out whether relationship is legitimate or not (not sure but this is what I heard).

There is no any guarantee to get a visa even if he is married as the CO suggested. I can give you a couple of examples that their CR-1 visa application was denied. But, one of them granted the visa after they went through a DNA test for their 6 month daughter and the parents. In the first interview CO said it was a fake marriage, however when the husband mentioned that he got a 6 month old daughter, they gave him 3 weeks to bring the DNA match test. That embassy is unbelievably terrible. My Senator couldn't believe why my fiancée was denied after he saw the evidences I took to his secretary. Never give up. Fight, you will win.

Did you show them your Engagement pics showing that you are in truly engaged and i guess that is most Important plus you need to vindicate them more communications proofs such as emails chat and history Flight tickets and visa Stamps

hotel Receipts and plus when ever you met the pics of those place shows a strong evidence
