Don't include your stepson because he has his own petition. Count him only as a dependent lower on the form.

Thanks a lot pushbrk for your reply!  I have more questions for you and others below:

1.) By the way, pushbrk – mentioned I should include my dependent on line 21d of my i864 – this is even though they're not here yet in the USA?! ***I thought this section #21 my household size is for USA domiciled only!?

2.) Anyway, on my BIL i864 and on (Part 1, #1e) I checked the box “I am the” for my BIL and then on the next boxes, which one should I check, box “first” or box “second of two joint sponsors” for him?!

3.) Now, my question is on my Sister's i864A on (Part 2, #13) whose name should be here as the Sponsor, my BIL or myself?! ***I think it should be my BIL especially that on (Part 1, 8c) I checked box “Spouse” for my sister.

Thanks for your understanding – I just want to do stage real slow but surely. From Darell, page 2 #21 he said,

“I must pick 2” and those two are GOOD and CHEAP, disregard FAST!!! Thank you all... and God bless! (F) (F)

5. On IV Packet according to EZGuideSpouse #7 item i- ) Original/Certified divorce decree of the beneficiary's prior marriage. We both got divorced, do I need to include my original divorce decree with this IV packet as the petitioner??

5. You don't need to send your documents with the DS-230. Remember, the DS-230 pertains only to the applicant/beneficiary. They should already have a copy of your divorce decrees as you would have sent it with your I-130 packet. Make sure to get the original/certified copy to your wife so she can bring it to the interview.

6. Yes, you can.

I'm afraid you'll have to wait for someone else to come along and answer your questions about the I-864. I'm not sure about that as we didn't need a joint-sponsor and don't want to give you wrong information.

Best of luck!

2. Still don't know which “box” to check first box or second box??

You won't check a box, you enter a number. If it's a single number, enter it in the right box.

3. Still don't know whose name to put on my sister's i864A Part 2, #13??

On your sister's I-864A, she will put her name.

4. Since I, myself live with my Sister (filing I-864a) & BIL (just to verify again does my BIL need to use Form I-864a instead of I-864) per LingChe NVC ShortCut, #10 ??

You BIL should use the form I-864 as previously stated in this thread.

5. On IV Packet according to EZGuideSpouse #7 item i- ) Original/Certified divorce decree of the beneficiary's prior marriage. We both got divorced, do I need to include my original divorce decree with this IV packet as the petitioner??

See Caly's answer.

6. Lastly, can I mail the AOS and IV package at the same time in two separate envelopes but in one express mail envelope??

As caly already said, you can.

You're getting great advice from people, but since you asked for my feedback...

Ultimate authority on AOS is the NVC

Link to NVC site (scroll to bottom for co-sponsor scenario)

http://travel.state.gov/visa/immigrants/info/info_3197.html

HOUSEHOLD co-sponsor checklist:

http://travel.state.gov/visa/immigrants/info/info_3203.html

PRINT these next two files out and review them before you send in your forms.

Nice PDF file of OFFICIAL instructions for I-864

Nice PDF file of OFFICIAL instructions for I-864A (co-sponsor form)

http://www.uscis.gov/files/form/i-864ainstr.pdf

And, as always, if you get a nice phone rep, he/she will try to help you with these questions.

“A separate Form I-864A must be used for each household member whose income and/or assets are being used by a sponsor to qualify. This form must be submitted simultaneously with Form I-864.”

yeah - true, the embassy makes the final decision, but I meant the government agencies who publish the instructions are the authorities on how to fill out the form. Not VJ.

My links are to really detailed instructions on how to fill in the forms - published on the USCIS site, not the NVC site. Odd, but true.

NVC is also not the government agency who publishes either the I-864 or its instructions. It's a USCIS form with excellent instructions provided by USCIS. Decisions on public charge issues involved in visa cases are the responsibility of Consular Officers. For adjustment of status, it's a USCIS adjudicator. NVC will reject incorrectly completed affidavits of support but whether the sponsor qualifies is left to the Consulate.

Thank you guys as always – you're simply the BEST!!!

Well, it's finally done – we did it!!! Express mailed both AOS & IV DS-230 on 9/20/11 and arrived at NVC on 9/21/11. Also, I have included an Expedite Letter, again!

So, today I received an email from NVC and states, “Your inquiry has been received at the National Visa Center (NVC.) The U.S. Embassy/Consulate General has accepted this case for expeditious processing. This file will be immediately forwarded to the U.S. Embassy/Consulate General. Any further questions regarding processing or the interview appointment date should be directed to the U.S. Embassy/Consulate General.”

1) Is the above statement means, we are done with NVC or Case completed??

2) But I just checked the Payment Portal and no SIF yet!?

3) To Whom and How do I contact the U.S. Embassy/Consulate General for info??

Thanks for the help, as we still need to set up a boat going to Manila for the Medical Examination! God bless us all for immediate and easy Visa Journey!

Glad to hear your case is moving quickly!

You should probably just call the consulate's immigration visa department to ask.

http://manila.usembassy.gov/contact.html

However, it seems they are closed Sept 27 and 28 due to heavy rain from Typhoon Pedring. According to the Manila consulate webpage, they should re-open on the 29th of September.

Well......... jeez!!! No reply yet?! My case completed on 9/27/11 and the USEmbassy Manila has accepted my case for expeditious processing. I even tracked my file which arrived via DHL Express on 10/3/11 but until now I still haven't heard anything from the USEManila?!

I emailed them IVMNLAppointments@state.gov on 10/4/11 but I just received the auto-reply, “We have noted your concerns. Please note, however, that early appointment requests will be approved on a case to case basis (i.e., aging out cases in 60 days or less, or in cases involving personal or medical emergencies), and only if visa interview slots are available.”

On 10/10/11, I called the Appointment Services at (214) 571-1600 to find out the status of my file and seems like I just spoke to a Call Center Agent and she just made a profile for my wife's application!? http://manila.usembassy.gov/wwwh3023/contact-us.html But until now still no reply?

Today 10/13/11, called the same number to find out more about my file and after talking to the agent, she said, “She thinks they (the USEManila) have my file already and if I'm ready to set up for an interview appointment – she can input it already?? Huh?? I just wanted to know if they're working on my case still or what? So, I asked her when is the next available interview date and she told me 3rd week of October, which is next week?? What do I do? Do I wait to hear from USEManila or just make this next interview appointment?:blink::help::blink::wacko:

Wow, you're so good caly woot woot, awesome!!! I asked my wife yesterday to call the above local number in Manila and she found out that the embassy just looked at our file on 10/7/11. Then, when my wife finished with her Medical Exam on 10/12/11 (set up with just an email letter from the NVC) a few days later on 10/14/11 the Embassy finally sent the acknowledgment receipt and to schedule an interview appointment!? But they did so via snail mail in the Philippines which is around 10-14days delivery...jeez!

So, yesterday I called the Appointment Services again and they informed me if I wanted an October 20 interview date?! That was nice, 3 days notice lol... I declined, we're not ready, as my package of “AOS/original divorce decree” is not in my wife's possession yet. Apparently, my priority package to PI, which I mailed on 9/20/11 “Registered” has to go to New York first (from Texas?) and stay there till the 9/29/11 and up to now it is no where to be found, oh boy! With that I had to set up an interview date for November 9th and hopefully with the package at hand! Phew! In addition, I spoke with the Congressman's Liaison today to ask for assistance in formulating a letter that would help my wife during her interview at the Embassy.

Thanks again caly for everything and best wishes on the 19th... great POE date before Thanksgiving to beat the holiday rush!!!  :dance:
