ANY LPRs TRYING TO PETITION HUSBAND AND WIFE FOR A GREENCARD HERE IN THE US

My other option is to wait to file for citizenship. I have been an LPR for over 25 years. However, I spent the last 5 years abroad in graduate school, and only returned last year. I have read that I have to physically be in US for 30 months in previous 5 years, so I suppose that means I will have to wait until the end of next year to apply for citizenship.

How come you didn't file for citizenship before you left the country for graduate school? I would have a consultation with a lawyer and see if they can't plead a case for you so that you could apply for your citizenship sooner - 25 years as an LPR must count for something right?!?!

Other than that your spouse could come and wait in the US on a different visa - could she get a J-1 for example in her field of work? That would at least give you some time together. I definately WOULD NOT give your greencard for an H-1B - you'll just cause more problems I think in the long run.

If I give up the green card then yes, I will be starting at square 1. But if I have to decide between that and living with my wife, I would choose the latter. I had a consultation with a lawyer, and there really seems to be no other way. She would only be able to come here as an H1-B herself, which is not going to happen soon. The J-1 and F-1 she could not get since she is married to a resident here in the US.

Right now if I go the H1B route I am pretty much shifting my future plans to moving back to Europe, which I am not completely against. But the options I have are either wait a few years to live together, or drop the green card. I will not take this decision lightly, but it is looking like the only real option now.

RCozerCA, while you were waiting for your wife to get citizenship, did you just visit the US as a tourist as often as you liked? Or was it more complicated than that?

I understand the decision you have to make. One reason to wait for citizenship is that there is no limit on the number of Greencards issued for US citizens.

I came in as a tourist on vacation or to visit other relatives who live in the same area. I always had return ticket and a job in Canada so customs was a non-issue. I visited a few times a year; each trip was no more than a couple of weeks.

Be careful with your wife applying for any non-immigrant visa because you are LPR. That may give her issues when entering US. It is rumoured that could be considered an attempt to mislead. e.g. She is really trying to stay in USA and has no intention to leave as you are a couple... and that would mess up her chances of I-551 approval or get barred from I-551 application for x number of years.

That is why I lived in Canada until my I-551 was approved.

im already approved and is excitedly waiting for his interview this coming tuesday. visa will be there in 2-3 days and he'll be here right after his PDOS! im praying its not gonna take a month for all these... im aiming that he'll be here JULY 8

i will stick around as much as i can to help answer questions and all... been checking this site twice a day for 2 years now and its been a part of my daily routine and i believe it will be hard to take that out.

hi, im a new member here...as i read all the comments it is giving me a lot of ideas... im married to an LPR last Sept. 2010, he filed the I-130 last nov 2010 and we got our PD nov 7, 2010. Petition was appoved las March 29, 2011, we are so happy that things go smoothly. I got my case # from NVC thru email last april 17. I am praying so hard that Visa bulletin will work on our PD but as i observed it wont be that fast as i observe the cycle..I cant really guess the timing of the visa bulletin,,,sighhhh...hopefully soon..

APPROVED AND VISA WAS GRANTED!!! :dance::dance::dance: they say it might take 2-4 days for the visa to arrive and he can take his PDOS......

this website has been my attorney, my 24/7 friend, my mentor, my guide, my unloading system for my heartaches.... where "almost" everyone is willing to give the best idea and tips that they can to ease the hardship of being away from my loveones... i cannot thank this site enough...

it all came to a point were we are even friends in the real word. Yna and i have been communicating with each other every now and then just to catch up with our everyday living, and im so thankful that she's one of the "bestest" that got me through this journey.... looking back, everything was just a piece of art that the world wants us to go through to value this relationship more. it took us time, money, tears to finish all these. "stress" took a big chunk of my bad travel which i was stressing out too much with anything that comes with this process.... lesson learned? 1. relax, 2. take your time and not to be in a hurry of turning in documents that needs to be rechecked, 3. as long as your presenting all the documents that are needed and the relationship is true, real and honest? you'll get through this. it may take time for there are some instances that cannot be avoided but still.... as i always say, there is always an end to every run. 4. praying about it for God/allah/yaweh/etc only knows best... claim his promises and believe it!

i will still be here and continue to give whatever ideas and experiences i had to whoever is asking for it.... be strong, believe in whatever you have and you'll be in the same boat as i am today ... very happy and very excited.
