i just starting reading some info online and seeing that having a big gap between our ages is a potential red flag to denial. me and my fiancee have been together for 6 years and we never thought this could be a reason for denial. it took is this long to decide what we were gonna do as far as us getting married. but now the age issue came up..i am 23 yrs old and she is 31. i go and see her at least twice a yr since ive been with her, we have bunch of phone records, PICTURES, emails letters, pics with her fam, will they still deny her cuz of age?? i think i have enough proof to show its a legitimate relationship and that we dont care about age. how can we prove that age isnt a factor in our relationship?

The issue of age difference can be a red flag at certain consulates more than at others. For example, it seems quite routine in Manila (Phillipines) for the male petitioner to be significantly older than the female beneficiary and these petitions are approved quite easily, it seems. The reason for this is that consuls also have the discretion to judge petitions from a cultural standpoint and, because of this, it is not an uncommon practice to see these big age differences in the Phillipines because the culture allows these relationships. On the other hand, at Casablanca there is higher scrutiny for being a high fraud consulate and female petitioners who are older than their male counterparts face an added challenge because it is against the cultural norm for the female to be older -particularly if the age difference is big.

In your case, however, your age difference is not many years, but just a few. Equally important is the fact that you are still both of child-bearing age, an issue which is important in the eyes of many consuls. August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

Your age gap in not a significant gap and yes you are right sometimes age can be a potential red flag however they can not discriminate based solely on age. It appears from what you have stated above that you have sufficient evidence along with a long standing relationship with each other so I feel that this would help establish the validitiy of your relationship as well. One of the primary pieces of evidence is proof of personal meet at least once within 2 years prior to applying for the K-1 i that is what you intend to do and it appears that you have evidence to support that as well.

Hey! Your aeg gap is not that bad. I know some with almost 25 years age gap and they are together now. Me and my fiance is also having that age gap I am 24 years old and hes is 33 years old. I dont stress myself out of that issue because I know our relationship is genuine so they dont have any reason to deny us of our happiness. All the best for you!

I don't see your age (8 years) an issue. I am the woman and the petitioner and I am 21 years older than my husband. We dated 21 months before marrying. Yes it was long distance online dating before we meet but we have much documented proofs and affidavits from friends and family to show this is real relationship. I am currently with him in his country and getting ready to start my filing process. We were just married May 3rd.

One thing I know is this interviewers are trained and know all the red flags of a "mail order bride/groom" marriage. I am not sweating it at all. Heck my husband is 1 year younger than my own daughter. But no worries. Stay tuned for good happy news as this journey of the immigration filing unfolds. Best to you and your wife.

This is great news for me, as I am female USC and 24 years older than my fiance from India. Our attorney says as long as we can prove we have a legitimate relationship there should be no problem but I always have this doubt in the back of my mind as to what the CO will think. Thanks for posting, it keeps my hopes alive!

The age difference comes in to play when it is not the cultural norm for an older woman to marry a younger man and also when it is a high fraud country. In your case it is a small issue that you can easily address because of the length of time you have known each other. Detailed Evolution of Relationship letter should make it a non-issue for your case.

I researched this question quite a bit as my fiancee is 31 years younger than me. To some this seems odd and prejudice may play a role so the views of the person who interviews us can make a difference. According to experts age difference is not a valid reason for disqualification but it does raise questions. Specifically what is the younger person's true reason for marriage to this old goat? In our case it is simply true love and we hope that it will be apparent from our photos and hundreds of hours spent chatting and talking by phone. As with all cases the burden of proof is ours to show that we are interested in spending our lives together and that there are not ulterior motives.

I am also older than my Fiancee and also am female and on top of it all its a high fraud country. I am not nervous about the interview but I fear the age difference will be a problem. I am ten years older than my fiancee. I believe I have all proof to prove valid relationship. What else should I have???

June 2010 We went to Punta Cana for our birthdays also traveled to puerto plata and visited his family. He proposed to me and were engaged.

September 2010 Went with my cousin to pay surprise visit since he had gotten hurt and was in the hospital.

December 2010 - January 2011 Went with my mom to meet the family and spend christmas and New Years

Enough said. Now a hot issue, a very controversial one. There seems to be a trend in some countries of foreign men marrying American women and the women are considerably older. There is always a question if this is a problem. It never seems to be a problem for older men/younger women (My wife is 13 years younger, his wife is also considerable younger than him) Is it a problem? For us, USCIS, no. "Free to marry".
