hi guys.

i had today my k1 visa interview in frankfurt germany. and first everything went fine and during the interview as well and suddenly the officer said, that my fiance doesnt make enough money.

yeah he didnt quite hit the tax minimum but we got job letter from his second job and we were able to show he increased his income like a lot. this year tax retrun he gonna hit the minimum way over. but still for the officer it wasnt enough.

she told me we need a co sponsor, fill out the paper send them in and i get my visa.

our problem is just we so dont find a co sponsor. so not really a change for us.

my question is how long do we have to if god helps us find a co sponsor or show the new tax return??? cuz we dont wanna apply for the WHOLE k1 visa again.

can someone let me know do we have a year or less ???

we a lil desperate right now and my mood aint the best.

im really and very thankful for any advise or help. thank you all so much

Be thankful that they offered you the opportunity to get a cosponsor rather than outright denying the visa.. new tax return? You mean next year? not likely that they will wait that long... it would be best if you obtained a cosponsor in the next few months... the longer you wait the more likely they are to send the file back to the states...

Did you ask them if you can provide more proof rather than taking co=sponsor route? I would think this would be easier for your fiance to gather more proof of assets. Did you check if this is a possibility at all?

does your fiance has any friends that can co-sponsor at least I134? He may have more time to gather more evidence for I864..

Try to get co-sponsor ASAP, otherwise they will send the petition to the USCIS. If they send your petition to the USCIS, definitely sure you have to start the whole thing again.

Your petition for this K-1 visa -- including the Affidavit of Support -- is not to prove the future ability of the Petitioner to financially support the Beneficiary, but that he/she can do it right now.

Technically, if the Petitioner did not meet the minimum income guidelines (and did not have sufficient liquid assets, and/or absolutely cannot obtain a cosponsor) you guys had no business filing yet. It would have been more appropriate to wait until he/she had next year's tax forms. That's a long wait, but there is no way around it.

"Coming close" to meeting the minimum income guideline is not enough. So now, if a cosponsor honestly cannot be found, you more than likely will have to refile again later when the Petitioner has the proper tax evidence -- and pay to refile again, as well.

No one likes securing a cosponsor, but it would definitely be the fastest and easiest solution --

Point is, it was a mistake to initiate this petition -- let alone go into the interview -- knowing that you did not meet the basic requirements.

Hi! can I ask how much your fiance's income is right now? And how much he would've hit over? Cause my fiance is a $1,000 over the minimum and I am worried now that that won't be enough...?

Over is technically sufficient -- though consulates have leeway to make arbitrary decisions -- but the OP was under. And that's an immediate stopping block.

hey guys thanks all for ur feedback and info.

yeah we have a really hard time to find a co sponsor. the ppl who wanna do it dont hit the minimum cuz they have kids and then add me to the household as well makes the minimum way higher. and the ppl who could help us have some concern cuz it is a responsibility.

so we really dont know what to do.

yeah with his tax return he didnt hit the minimum by like 1000 dollar. so we called the uscis and they said when we increase the income with a second job it all will work out..

so my hubby had a second job and got way way more hours and he already hits the minimum way over know. but the officer at the interview thought no.

we really thinking all changes and options thru right now.

yeah we got the letter from the employer and all the pay checks and bank statement.

How long has he been employed on this part-time second job. Remember the key word is part-time.

yeah he has two jobs cuz he finish his college this year. he has his jobs since 2008.

Are you saying that he has 2 part time jobs, neither is full time employment.

If that is the case, then this is why the CO is requesting a co-sponsor.
