hi guys. some of you may be familiar with my story. to sum up quickly, i married my k1 wife 2 years ago. the AOS case was canceled the following year, the letter she received never said anything about her having to leave within 30 days, it did mention that she could file for the case to be re-opened. i filed for divorce this past february which went uncontested and now i'm waiting for the judge's final decree to go through.

my question is, what happens next? what do i do next? my divorce lawyer suggested i notify INS of the divorce but that's all he said.

I would look closely at the status of the I-864, affadavit of support.

Supposedly, if the Adjustment of Status was cancelled, the Affadavit of Support never went into effect, but.

You can always withdraw that particular Affadavit of Support, prior to Adjustment of Status being re-adjudicated...

i see, should i write another letter to USCIS and withdraw the affidavit of support?

and belinda, i'd like to know what else i can do because she is currently living with my parents and working for my mom.

and if i contact INS, it wouldn't be possible to call them, right? would i have to send them a letter?

if there is someone i can call, which agency would that be?

I would personally contact ICE and let them know the story and that she's still living in the US and whatever so that she's on their system. Details at the bottom of the page. It's likely your family is helping her with a VAWA complaint. Have you heard anything about that?

i contacted ICE the last time i posted. i started talking to my cousin about the situation and he wanted to help my family after hearing what was going on. he contacted my parents and asked them about all the threats they made, and told them how i contacted ICE after they did all of that. they were angry about me calling ICE and making it harder for my ex wife to stay and said that they were just threatening me but didn't mean it. :/

they said they would never file a VAWA claim against me or put me at legal risk.

how does deportation work? will they ever enforce a deportation on a case like this?

Apparently they don't really hunt down specific people but if she's ever pulled over by police and what not they'll deal with it then.

At least your parents know you contacted ICE and it's not very nice of them to make threats like that!!

Your ex is just making it harder for herself to EVER come back. She should just go home and find another way to come back like work or student visa or something. She's being silly by overstaying and she'll regret it if ever caught.
