I recently left the US after overstayin my VW but left before the 180day mark. I missed my return flight and it was non refundable so had to wait for my boyfriend to make money for my flight.

I want to apply for a student visa, I have a school sorted but worried I wouldnt be able to apply because I just left and I had overstayed. I was hopeing to apply to start school in August but dont know if this is too early to try and would starting in January would give me better chances?

Also is it possible to apply and be accepted within this time (june - August)?

Because of overstaying I am concerned about ever getting a visa.. can i? Would I have problems?

Thanks in advance.

Have you been accepted into the school yet? If that hasn't happened you can't apply for a student visa

1st step, apply and be accepted into the school that is accredited and show you can financially support yourself (I had to show the school I had $20,000) THEN you can apply for the student visa

The student visa is a non-immigrant visa so you'll also have to show that you intend on returning to your home country, this is where the overstay may trip you up

good luck

Thank you for your reply.

I am waiting on the school and know I cant apply for visa until i recieve the I-20.

On the school website they have the fees and costs for everything, I calculated and I dont need the full estimate they say it can cost up to, as I wont be needing to pay rent.

I will have family sponsering me, can you have more than one sponser? also I read (not sure if it was on the visa or school website) that I need to show I have funds upfront for the first year and that I will have access to the rest. ??

I dont have a house a job or anything, Im only 19, what do they expect? I am wanting to come back to england to start a business (my boyfriend is comin to england to finish his study) Im studying nutrition and think I would get great experience in California. My dad has a Masters in business and currently doing his PHD, in my personal statement for the visa we are going to but my basic business plans in. Other than that I jst have Family and Friend ties.

The school said aslong as I get everything in for the school by the deadline I should have enough time for the visa, but I am waiting for the school to get back to my about some of my qualifications...does anyone know about the qualifications they accept from england?

Thnks

You have a family member and a boyfriend already in the US which is a negative. What do you have to show someone as a reason that you MUST return when you are done? With both an overstay and family in the US you need to think of something to show. You don't own any property ? Are you going to have significant employement in a family business ?

This will not be over quickly. You will not enjoy this.

The fact that you made 15 errors in such a short post tells me that English is not your mother tongue. Do you plan on getting a US High School Diploma or are you talking about a vocational school to study nutrition?

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . . The one absolutely certain way of bringing this nation to ruin, of preventing all possibility of its continuing to be a nation at all, would be to permit it to become a tangle of squabbling nationalities, an intricate knot of German-Americans, Irish-Americans, English-Americans, French-Americans, Scandinavian-Americans or Italian-Americans, each preserving its separate nationality, each at heart feeling more sympathy with Europeans of that nationality, than with the other citizens of the American Republic . . . . There is no such thing as a hyphenated American who is a good American. The only man who is a good American is the man who is an American and nothing else.

I wasnt planning on getting graded from an english teacher. I can very much so write with correct grammar but I didn't know this was a requirement on this forum. And to be totally honest I couldnt give a toss its not my main priority.

I would appreciate real replies from members that are actually going to help me.

Since most, if not all, of your stories are false, your chances are nil...

first, you violated the VWP privilege

second, you claim you missed the flight but 'had to' wait nearly 3 more months while your BF allegedly earned enough money for a ticket;

three, you claim family in England, but oddly, they couldn't pony up air fare...

four...you claim this same family will be your sponsor, (but see three above)

five...you claim you will return to open a business, which is the classic excuse of a desperate student visa applicant

six...you claim your BF will be heading to the UK soon...which is also the follow up to number 5 above

seven...you want to take Americans to task because your grammar is indicative of a sixth grade education, right after you violated our laws and are now looking for some other underhanded means to return to MY country?

Nice try.

Now, just to be even more helpful, I've sent your postings along with my opinion to the US Embassy in London....perhaps you should work on a new story. Oh yes, have a nice day.

These are good points, there is something missing in your story. You missed a flight and they could not re-book you on the next flight with just charging some fee and not the whole fare again?

Unheard of it, most airlines would accommodate you on that – secondly the family you claiming would sponsor you for your education were not willing to pay for your return trip home?

What your father is doing is irrespective when you apply for your student visa.

From your post it seems you were here in US with your bf, you overstayed your VWP and now you just looking for an easier route back in the country to be back with your BF.

You can make as many business plans that you want, that’s not a primary concern for CO when they interview you for student visa - also you business plan is no guaranteed that you will return back to your home country after your school is done.

The Grades would be the same as in the UK, good A Levels.

What do you have?

I was taken out of school because the family moved alot and I wasnt very good at doing school work off my own back so it was kinda bad.

I returned to college to do GCSEs but only left with a C in biology and a D in maths ( I was unable to resit the exams I missed due to an opperation)

I completed key skills along with NVQ level 2 Beauty therapy, I passed (C's) in Communication, Application of number and IT ( We were always told they are equivalent to GCSE's but America dont know what they are and need to have them evaluated.)

I also have a Diploma in Nutrition which will help towards what I want to do as im applying for Nutrition AS degree.

Right now the qualifications isn't what im having problems with.

The Consulate may think otherwise.
