Good Morning Everyone... After 5 years of a " stable " relationship, long 7 months with nights without sleep and thousands of dollars spend in lawyer, USCIS fees and trips there, unfortunally I have noticed after my fiancee got his visa things has changed and two months after he got it he is not doing the effort to be here with me, instead he only respond he has six months to enter USA, and his atitude towards me and the relationship has changed, I have been aware by his sister of infidelity while me suffering here for him. At this point I do not want to marry him anymore and I would like to do a visa withdrawal. Does anybody knows what should i say and where should I send it ? I am devastated I never thought I will be going through this situation !!! Thanks

Oh please the guy is a jerk and has no intention of marrying her as he is not here yet. I will bet money he thinks he can just come here and stay because he has the visa but he does not know the laws that go with the K1 so he is sadly mistaken. Why would you try and tell her to give him a second chance when he is an #### hole and cheating on her anyways. Are you mad??????????:bonk: How would you feel if the shoe was on the other foot. really :no:

Bummer. Sorry about your situation.

The visa has been issued. You can't withdraw the petition now. He can use the visa to come to the US, if he chooses to do so. However, you are not obligated to marry him or help him adjust status. If he comes to the US and doesn't marry you then he won't be eligible for a green card, and his status will expire in 90 days. He'll either have to leave the US or remain without lawful status. Because he has a K1 visa, he can only adjust status by marriage with the K1 visa petitioner, which means you. There would be no other practical way for him to get a green card.

Jim, since this man is still in DR & not travelled to US, can the petitioner send an affidavit to the US embassy in DR informing the situation and have the US embassy revoke his visa? It is clearly has weight on it as after all he got his visa because of this lady. If the lady pull the plug now he is in trouble isn't it?

Wow I am so sorry to hear this and I wish things would be different for you. As others have said, just let USCIS know of your intentions and just move forward from there. I wish you the best of luck. Again so sorry to hear about this!

I just looked through the Foreign Affairs Manual. Apparently, I was wrong. The petition can be withdrawn up until the time the foreign beneficiary arrives in the United States. This is according to 9 FAM 41.81 N7.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

I am very sorry to know that your relationship has come to an unexpected end. I hope you can find the strength to rearrange your life, accordingly. Do make sure to call the Santo Domingo Embassy and USCIS in order to revoke the visa's validity if you are absolutely certain of your decision. It would be a shame if he decided to use the visa to enter the US without the intention to marry you or be with you, at all. Also, I know it is hard to see, but it is really much better for you to have realized this rotten truth before he came to the US and before you married him rather than having gone through with the marriage only to get a divorce later... It is better to cut your losses now.

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.
