Hi Everyone,

Well, I received my NOA2 today via email. That's the sweet. The bitter is: on the week of April 4th I sent a letter asking that my petition be withdrawn. My fiancee and I had a big fight and in a moment of stupidity I sent that letter. The following Monday,the 11th, I sent a letter to VSC via fedex overnight asking that my previous letter be canceled and explained why. My fiancee and I have resolved our misunderstanding. So at this point I have no idea if I will be receiving a letter in the near future saying my petition was withdrawn. I guess I'm writing this post to anyone who is having problems with their loved one who is far away and is thinking of sending that withdrawal letter. Take some time to think about it and really make sure you want to send that letter. I'm going to call USCIS tomorrow and ask if my withdrawal letter had been canceled but I really don't think they will be of much help. I guess I'm in limbo now...

This whole immigration process is so stressful :( it does take over your life....i'm glad you were able to come thru the misunderstanding and continue with your love...even if it is withdrawn you both will be stronger...just take one step at a time..see what happens and just take the next step as it comes...good luck and best wishes!

Hey, if you already got your NOA2 you might be in luck! Yeah talking to USCIS is like talking to a recording but maybe you can make them understand its urgent that they don't cancel it, and you need to talk to a tier 2 person.

Relationships are hard as it is but the long distance multiplies the misunderstandings and arguments. Hope you get a break on this one, good luck!

Thanks. What is a tier 2 person? When I call USCIS do I ask to speak to a tier 2 person?

Yeah thats what I read on some of these posts. Apparently there're different levels of people at the service center, the tier 2s have more knowledge or maybe put in a service request, hopefully to do something for you.

Maybe somebody else here can tell you more, or maybe do a search on here on, 'calling USCIS' or something.

P.S. Or maybe after you talk to the first person and can't tell you anything ask if you can speak to a tier 2.

Yes Tier 1 is the first person you get when u call USCIS...I actually always had to talk to tier 2 because my case was never updated in the public website so they couldnt see it either on their system...tier 2 are able to look more in depth into the system...and i guess it moves up by that...I never hd to go beyond tier 2... good luck and im glad you worked things out!

Call, interrupt them as they read their robot-script, and ask to be escalated to an immigration officer (IO). The robot will object, but stand your ground. The robot will object again, but say that he or she is required to escalate your call upon your request, and you are thus requesting. This should work, but if you get a third objection, collect a name and ID number from the robot. When you speak with the IO, it helps to begin with something like "I'm so happy to be talking to you! I KNOW that YOU can help me," and state your situation. Once the IO notes the computer, you might also ask, "Can you please send an e-mail to the floor to ask someone to carry my file to the next place where it needs to go?" (Asking this can't hurt, and it may help.) At the end of the call, be sure to thank the IO effusively.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

from my experience from my 1st petition. my ex cancelled our petition after we got our noa2 but still i recieved a letter from embassy stating that i can have my interview and so i went but they found out to their system that it was cancelled so then they told me to tell the petitioner to call them if he wanted to continue the petition then they give me another appointment for interview...but i didn't continue it...so just sharing based from my experience. i hope that will help..

I almost withdrew mine. I think I posted on your original post also.

Today she picked up her passport with the visa stamp :)

just a little advice for people who read this and may be considering withdrawing their petition,dont rush into it.

you will have time to withdraw it whenever you want,so if you break up,give it some time,make sure its not just the stress of the process and then send the letter.

im saying it as some one who was THIS close to screw it all up over the stress of going over 5 months and packet 3

definately follow up with USCIS. also start hitting the NVC electronic payment page to see if the bills have been generated. As one other poster pointed out, it could make it all the way to the consulate but end up being cancelled there, so be prepared with both your letters and additional explanation if needed. I think the people adjudicating the case know that we are human and this is an incredibly stressful process. They will do their DD, but this has happened before and it will happen again. Stay positive and be prepared :-)
