Possible Policy Change at USCIS or Anomaly?

Referencing this thread, http://www.visajourney.com/forums/topic/303536-packet-for-k3-visa-received-directly-from-embassy/page__gopid__4587499#entry4587499 it appears we'll want to watch closely what happens with other cases. Did this I-129F arrive ahead of the I-130 due to some anomaly or is USCIS continuing their turf war by delaying mailing the I-130, so NVC has to process K3 visa petitions again. We can only wait and see. This may be good news for the few that actually NEED the K3 visa instead of an immigrant spouse visa.

Facts are cheap...knowing how to use them is precious...

I know the K3 couple that is being processed in Lagos has an out of wedlock daughter that wasn't reported to the consulate because the father didn't know for 10 years but will qualify for an N600 once in the states. Maybe the K3 is being processed to help get the daughter here with a K4. It would be interesting to know if the other K3 that seem to be slipping through involves couples with children.

This will not be over quickly. You will not enjoy this.

I vote anomoly - the I-129 arrived 2 days prior to the I-130, on that PARTICULAR case.

I understand the news about a year ago regarding ending the K3 and that if both the I-130 and I-129f hit the NVC at the same time the I-129 is shut down while the I-130 lives on. Does that mean that the I-130 is the driving in all situations? More specifically, what if the I-129f hit the NVC months after the I-130 was completed at the NVC. Before you hit me with all types of logically answers regarding the processing time for an I-130 please know that I am one of the many people patiently awaiting an interview for my spouse at the embassy in Ghana which is backlogged by over a year for scheduling CR1 visa appointments. We just keep looking for ways to get into the interview doorway. I also understand the advantages in the CR1 from a transition and expense perspective. Believe the additional fees associated with the K3 are a lot less than trying to visit Ghana and keep up with the mountain of phone bills.

For that to happen would be quite freakish indeed but it the I-129F would still die. Freaky because it's illegal to approve an I-129F for a spouse, if the I-130 is already approved. A pending I-130 is required. An approved one is no longer pending.

Thank you Pushbrk. We keep trying in Ghana - at the end of this process we will be the most patient or insane group of people who have ever tried to bring their spouse's to the US. It is so frustrating when you are told that the backlog is do to a need to process the diversity lottery visas - I am sure that some of our taxes have supported that process. This comment is not directed at those going through the dv process - it is directed at our government who has chosen to lower prioritize the reques to a system of non-petitioned and possible non-connected and possibly government supported immigrants. I guess we know where we stand. Back to prayers - oh, and the tax deadline is approaching - let me do my part as a US citizen and mail off this check. :hehe:
