So,

i didnt mean to ask this here but uscis doesnt help me.

Does HIV qualify for an expedite as a medical condition that is severe ?

No as they don't test for HIV any more or not that I am aware of.

HIV tends to be a medical condition that makes a person in-admisable to get an immigrant visa. Who has it? And no, to qualify for an expedite on medical grounds the condition would need to be urgent, as in life/death.

Section 212(a) of the Immigration and Nationality Act reads:

(a) Classes of Aliens Ineligible for Visas or Admission.-Except as otherwise provided in this Act, aliens who are inadmissible under the following paragraphs are ineligible to receive visas and ineligible to be admitted to the United States:

(1) Health-related grounds.-

(A) In general.-Any alien-

(i) who is determined (in accordance with regulations prescribed by the Secretary of Health and Human Services) to have a communicable disease of public health significance, which shall include infection with the etiologic agent for acquired immune deficiency syndrome,

Agree it doesn't qualify. Only exception would be if the USC petitioner was close to death from a HIV related infection, then it might qualify.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

What would be the expedited reason?

Do you need medical treatment that is not offered in your country?

If your condition is severe are you physically able to travel?

Will your SO have sufficient Insurance coverage to cover your condition, which wouldn't leave you in the position that you would have to rely on the US for medical care.

Someone who is in a severe stage of HIV needs alot of medical care, so USCIS would have to take all of this into

consideration.

You have confused everyone, so it's the US citizen who is HIV postive. On what basis do you the SO need to have the visa process expedited? Again, is the OP illness at the stage that he needs to be in a Hospice facility?

I never meant to reach out to the public to ask this but on his behalf I did, since he is as impatient as I am.

He has been diagnosed with HIV and isnt in too good shape, but not dying. He is in treatmeant, but it is of course an Impact on us.

He is the Petitioner.
