hi vj members,

This is regarding my friend. Here is the situation. Both are from the Philippines. The US citizen (male)wants to file a k1 for his fiancee.They met june 2009 when the US citizen went for a vacation in his country, Philippines where the relationship began and he stayed tthere 4 months and went back to the US.Now he is planning to do the K1 and if approved, they will get married in the USA within 90 days after POE right?

HERE IS THE QUESTION;

1. After they got married is it possible that his fiancee will not file for adjustment of status? Because they both plan to return back to the Philippines to study.

2.Can he just file for CR1 later on? will there be a problem?

You might ask why would he file for K1 when they will go back to the Philippines after the wedding? The reason is the parents of the US citizen(male)wants the wedding ceremony to be held in the USA and He also wants his fiancee to visit and see the beauty of USA.

You don't need a visa to get married in the states. You only need a visa to get married with the intent of staying. They can get married here and they can go back to Philippines, and file CR/IR-1 if they want to move back. Good luck.

You don't need a visa to get married in the states. You only need a visa to get married with the intent of staying. They can get married here and they can go back to Philippines, and file CR/IR-1 if they want to move back. Good luck.

Thank you, i know no visa is needed to get married but a visa is needed to travel to the USA. His fiancee does not have a tourist visa and its hard to get one here in the Phil. so he was thinking of filing for a K1 instead.

if they are planning to get married here in US then back to Phil.right after the wedding to study they cannot go back to the Phil right away after marriage other than they filed for their AOS or adjustment of status then file for an advance parole if approved then thats the time she can go back to the Phils but i guess theres a limited time or months to stay otherwise it will called as abandonement of status .

I agree with this... try the tourist visa route first... before resorting to K-1 route...

The K1 is costly, time consuming, and can be emotionally exhausting, not to mention that it puts a severe cramp on being able to make any serious wedding plans because you have absolutely no idea when (or even IF) the visa will be issued. If they plan on turning around and going back to the Philippines after the wedding then a K1 is not a good idea. On the other hand, the odds of getting a tourist visa in the Philippines is slim. If she admits she wants the tourist visa so she can get married in the US then the odds are zero.

I would suggest they wait until they're ready to move permanently to the US and THEN apply for the K1.

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!
