Hi everybody,i couldnt find the same question in the forum so i decided to ask it myself since everybody's situation varies..

so to make the long story short,i got in the states on a j1(2yr rule does not apply) in 2008 got married while my visa was still valid, but couldnt file for AOS then, now 3 yrs later we r finally doing it,but since ive been out of status for 3 yrs-on the question whats my current status do i put 'out of status' or do i put J1 exchange visitor and then put the date it expired..??? i dont know how this 'out of status' will look on the application, but on the other hand i dont want them to think that im trying to lie or something..sooo if theres anyone who was in the same situation or is able to help please give me ur opinions,

thank u guys :)

thank you both!

Just and FYI... you should read and post in this forum: http://www.visajourney.com/forums/forum/130-adjustment-of-status-from-work-student-tourist-visas/ as you are AOSing from a J1 visa. Everyone in that forum file the I-130 like you will and of course other people AOSing from a J1 like you.

Good luck!

p.s. You will get a 10 year greencard because you have over 2 years of marriage.

Do NOT leave the USA for any reason. Get your GC first and then you can visit outside USA.
