***** Moving from K1 (fiance) to CR-1 (spousal) forum *****

The K3 is dead, the paperwork will be administratively closed at the NVC stage, you will end up with a CR-1 spousal visa. Process takes 6-12 months, unfortunately probably at the longer end for you as Montreal takes a long time to schedule interviews.

It's not going to be done in 7 months, but if you move back to India, they can transfer your case there so you can interview at a US embassy in India.

Hi, so wht i understand that's there is no K3 visa I filed a k3 that's mean they will change it to CR1 automaticly or I will have to start over again

K3 is a visa. You don't file it. What exactly did you file? Filing an I-130 petition for a spouse of a US Citizen will put you on a CR1 or IR1 visa path.

thks all so how long thta's take to get a visa???

From petition filing to visa interview, think in terms of 8 to 10 months. Then expect at least a few weeks of additional security checks after the interview.

My alert though is that this information may have become less important. It seems USCIS is avoiding sending both petitions together. ####### for tat between agencies with a long running feud. Things can change quickly, sometimes without notice and may have again recently on the USCIS end. I still don't recommend the K3 unless there's a special reason for it BECAUSE it really hasn't saved any appreciable time since 2007.
