hey, i have a question in regards to renewing the I-94. my fiance's b-1 expires in april and we are trying to renew it so she can stay in the country. we were wondering if marriage would help extend her stay or she could renew it by traveling to either canada or mexico. can anyone help me answer these questions? thankyou

Marriage in and of itself grants no permission to remain in the US. That would require filing for an adjustment of status. She could try traveling to another country but CBP may look at her entry/exit record and see she is really living in the US on a tourist visa and deny her or just give her a few weeks on her new I-94.

She could try filing for an extension.

a possible method - is to marry now, file an AOS package to USCIS, forget about I-94 extension.

It's very risky - you have to be able to prove up that you had no intention to marry when coming into USA on yer B-1 visa.

Traveling to either Canada or Mexico will not get her a new I-94. She may file for an extension but that takes time too and the outcome is unknown. If you want your fiance to stay you need to get married and then file for Adjustment of Status afterward.

We met each other after 3 months she came here. She had no plan to stay. She was thinking about going back to China on Mar.

BTW, how should we prove that when she entered US, she got no intention to stay??? Should we explain when we mail all the things??

In addition, should we mail all the supporting documents out together with I-130, I-485 & I-765? Or we just need to provide when when interview??

suggest you write up an evolution of relationship letter, include it with the I-130 and I-485.

Since you not know her prior to her coming to USA, you have good shot (but document, la)
