what happens with deriviates

My children are the deriviates in our case. Marriage to USC. If I file VAWA what happens with their status , the oldest is 19 and I read here from other posts that it can take 15 months for case to be approved, do the children's age count from the date filled or date approved? what is the age limit? 21?

They have to file for adjustment under VAWA as well. If the petition is accepted before they are 21 then their status is protected if they reach their 21st birthday before a decision is made. In other words, their age is locked as of the date the petition is filed.

so if I understand correctly their age at the date of filling is the age which will remain during the whole process, regardless if it takes more than a year?

Thas correct. once file under WAVA, it will be adjusted same way you are. Aged out children is not valid when you are already in USA. Priority date didnot change for WAVA.

Totally off topic still, even though it's VAWA I actually think WAVA makes more sense when you say it in fully "Violence Against Women Act" versus "Women Against Violence Act" lol ahhh well..

I think it should be "DVA" - Domestic Violence Act, since it applies to men as well as women.
