Hi Guys,

I became U.S. citizen in January and my parents are here in U.S. I wanted to know what kind of form I should fill up in order to make them legal here.

This is a great site and I know many of you guys are here to help. Thanks for any reply and advice.

CR-1 Timeline

March'07 NOA1 date, case transferred to CSC

June'07 NOA2 per USCIS website!

Waiver I-751 timeline

July'09 Check cashed.

Jan'10 10 year GC received.

How did they get here, with a visa and overstay, or illegally? There is a difference in the process...

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Yes, they had a visa and overstay. Do I still have to use the I-130 form?

I checked the fees and it says that it will cost $420...is it for both parents? or do I have to pay $420 for each of my parents.

Sorry if I sounds dumb but I want to make sure that I got this right :)

You need to file two forms I-130: one for each parent; as a result, you will need to pay $420 fee twice - with each I-130. You can mail two I-130 for your folks in one envelope so your parents' cases will be looked at by USCIS at the same time but you still need two forms and two checks - each for $420 to file I-130.

2010-10-04: I-130 Sent for both parents via Express mail in one envelope.

2010-10-08: NOA1 email and text notification received. Both checks cashed.

2010-10-08: Case numbers assigned: both cases sent to California Service Center. Cases available online.

2010-10-15: NOA1 hardcopy received by mail.

2010-10-18: Both cases "Touched" online.

2011-01-21: NOA2 email received. Cases approved in 3.5 months.

2011-01-27: NVC entered both cases in the system. Auto update by phone.

2011-01-28: Called NVC to update my email address.

2011-01-29: NOA2 hardcopy received by mail.

2011-01-31: NVC sent me emails about AOS fee and Choice of Agent forms. Paid AOS fee of $88.

2011-02-01: Sent Choice of Agent forms to NVC via regular mail.

2011-02-02: AOS fee status online: PAID. Printed Document Cover Sheet.

2011-02-03: Mailed 2 forms (for both parents) I-864EZ, Affidavit Of Support to NVC.

2011-02-04: Called NVC: Choice of Agent forms received on Feb 3, 2011

2011-02-07: Called NVC: IV Bill fee is ready to be paid. $404x2 paid for both parents online.

2011-02-08: IV Bill fee status online: PAID. Printed Document Cover Sheet.

2011-02-09: Received email from NVC asking to complete an Application for Immigrant Visa.

2011-02-12: Mailed DS-230 packets for both parents to NVC via express mail.

2011-02-14: Recieved USPS confirmation that DS-230 packets were delivered to NVC on FEB 14, 2011.

2011-03-01: Called NVC: they received DS-230 and biographic data on FEB 28, 2011.

2011-03-11: Both cases completed!

2011-03-26: Received email from NVC: interview for parents scheduled for May 9, 2011 in Warsaw, Poland.

I-130 to get a visa number, and I-485 to get a green card - one of each form for each parent. The I-130 is $420 each. The I-485 is $1070 each. Total is $2980.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!
