Hello everyone. Im new to this site and I really need someone who can help me with informations about my case. Im in a relationship with a US citizen who is based in Guam, we are together for 18 months already and so far, so good. We do have plans for the future but before we decide of getting deeper in our relationship, there is one big question I want to know. If there is a possibility that we can get married in Guam or in the US when in fact im a separated woman here in the Philippines? Im separated for almost 7 years now. I raised this question cause for me this is different from other filipina who applies a fiancee visa. They are single and I dont think they are going to have problems but mine I feel is different.

Please help me enlighten my mind about this issue.

Initially you have two issues that I can see just from reading your post.

1. It seems that you still have questions of whether you want to marry your boyfriend. To qualify for a K-1 (fiance visa) you have to be engaged. In other words, you already agreed that the both of you want to marry.

2. You are only separated. To qualify for the K-1 visa, you have to be free to marry (divorced in your case).

However, I will say that once you get engaged and divorced, you met those two requirements. But keep in mind that there are other requirements (i.e. have met in person within the last 2 years, etc...) I just realized I didn't answered one of your question. You can not marry someone while you are still married to someone else. That is illegal. A separation is not a divorce. You must first get divorced, then you are free to marry someone else. But if you marry him overseas, you no longer qualify for a fiance visa (K-1), your only option then is CR-1 (for already married couples).

I must be free to marry for a K1- separation doesn't count. I believe there is no divorce in the Philippines; thus, you will need to get an annulment. This can be expensive and take a long time. Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

If you plan to use a K-1 Fiancée visa to travel to Guam or the U.S. to get married, you will need to get an annulment before the U.S. Embassy Manila will issue your visa.

Also, it's my understanding that you can not use a tourist visa to travel to Guam or the U.S. with the intention of getting married.

The very first thing u need to do is have ur previous marriage annulled first. You can never marry someone else unless u are FREE to marry-meaning u are not married to someone else. Separation is not accepted no matter how many years u two are separated. have an annullment first then go to the next step.

I remember seeing a post where someone who was originally from the Philippines had a divorce done in another country. I can't remember the name of the other country or what forum that other post was in. Can anyone else with directing the OP to that post?

Unfortunately it won't help her because she doesn't live in Guam.

As part of your filing, you must send in a certified divorce decree/judegment. Since you are still married, you NEED to be fully divorced before you file.

The very first thing u need to do is have ur previous marriage annulled first. You can never marry someone else unless u are FREE to marry-meaning u are not married to someone else. Separation is not accepted no matter how many years u two are separated. have an annullment first then go to the next step.

Annullment is acceptable but divorce is acceptable also. They are two entirely different things.

I think I'm going to move this thread to the Philippines regional forum to avoid more incorrect information. It is my understanding that there is no such thing as divorce there..... only annulment.

My underatanding is that divorce will soon become legal in Philippines in the coming years.

my brother just went throu this.......ANNULEMENT FIRST....you have to be free to marry....hears a tid-bit..he spend between 5, to 7 thousand dollars and thats paying everybody off alone the way, they told him 2 ,months it took 7 months, the first judge he paid off.went fishing :bonk: good luck, it can be done.. :whistle:

Where did you get married? If in the PHilippines, then you have to file for annulment.
