When is affadavit of support required to be filed? Is it after the 2NOA? Can we get it ready before the 2NOA? Does 2NOA specify when to file it?

My fiance's company has lost a contract and he might be unemployed in couple of months... which is exactly the time when we expect to get the 2NOA (1NOA November 1, 2010). What happens then?

I read that unemployment counts as income but cases are denied. Is it better if he gets any job (even if it pays less than unemployment benefits he might get)?

The affidavit is needed at the interview to show that the fiance will not become a public charge. As long as the beneficiary made above the 125% poverty line on their 2010 taxes (the figure is 18,383 for 2 people) you guys should be okay. Having a job will look better than having unemployement. You can also have a cosponsor if you cannot mean the requirements. The cosponsor has to be a US citizen and make 125% above the poverty line INCLUDING you in their household size. Some countries will not take cosponsors though.

Affadavit of support is presented at the interview. If he is unemployment he would need a co-sponsor. He can go ahead and find one if he loses his job so that the sponsor can prepare their documents.

You are actually referring to the petitioner (the US citizen). The beneficiary is the immigrant. The petitioner's income is what matters, not the beneficiary.

Having a job will look better than having unemployement.

You will need to have a current job. If you are unemployed, then you must have a co-sponsor, if your consulate allows it.

When can we get the Affadavit ready? Can we do it now, while my fiance is stil employed? Or do we need to wait for 2NOA? Does Affadavit expire?

You need to do it after receiving NOA2 (when you get P3 from the consulate). He will need a CURRENT letter from his work proving employment, as well as up-to-date pay stubs.. so no, he can't do it now while he's employed.

You would be better to line-up a co-sponsor to be safe.
