CatNaz,

Buenos deseos! (F)

CatNaz,

The members need specific information to be able to advise you about your particular case. It sounds very strange that your case would have taken so long at the NVC stage if it really is a fiance visa petition what your American fiance filed. More details are really needed and without language errors to be able to help you.

Best wishes! (F)

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

Go confidently in the direction of your dreams. Live the life you have imagined.

Hi Cat Naz,

I hate to be a devil's advocate here, could it be (remotely) that your fiance is having second thoughts about this and had to tell you something, somehow, anyhow..... ? As fellow-VJ'ers have mentioned, things just don't add up.

Good luck with this nevertheless.

Hello, one of the best immigration attorneys, in my opinion, in the country is John Roth Law Firm. I used another attorney to help with the k-1 process for my fiancee' in China. I got no where for months. We were so frustrated. My fiancee's friend in China was going through the k-1 process with her boyfriend and recommended John Roth to us. This was her lawyer. Immediately, he took control of the situation and filed for us. Our application to petition for a k-1 visa has just been approved and sent to Guangzhou, China to the Embassy and packett 3 has been recieved by my fiancee'. This was only done in just 5 months. Her expected interview should be by mid April at the latest. His phone number is 1-(845)623-1100. His firm handles everything in the area of immigration and green card help, etc. I would highly recommend him. He has 100% success rate. This is just a suggestion and recommendation if you need a good experienced attorney to help with your denied visa.

This is almost certainly poppycock, friend.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Maybe, but success rate at what? If for getting petitions approved, as many advertise, it probably IS true. That's the easy part. A recommendation is a recommendation, so a positive thing but a claim is not a fact, just a "claim". Regardless of the success percent, there are no and can be no guarantees of success. Success in overcoming a denial is an entirely different matter than managing a successful process from beginning to end.

Facts are cheap...knowing how to use them is precious...
Understanding the big picture is priceless. Anonymous

He has 100% success rate.

Unless he has handled very few cases, this is virtually impossible. Even a lawyer who is extremely thorough, and pursues the required information and evidence with due diligence, is occasionally going to be faced with a client who withholds some critical information that results in a denial. There is just no way to avoid this. Any lawyer who claims a 100% success rate is either fresh out of law school, or he's lying.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!
