Hi everyone, I was not sure where to post my question, I hope I will get answer even here in off topic.

We are just at the very beginning of our journey to K1 visa, actually we just know that we will file for K1 as soon as we will be able. Our the trouble is following. My honey is now in a difficult life situation and food stamp program would help her and kids a lot. But we were wondering if getting help from state can not cause troubles later when we will be filing for K1 visa. Does USCIS take receiving food stamps into consideration? If they don't it would really be a great help until I can get to USA.

Well, she will still need to prove that she is capapble of meeting the povery guidlines to be your sponsor, or you will need a co-sponsor. Not sure what the income cut-off is for food stamps, but I would imagine she might have trouble meeting the poverty guidlines!

my first thought was if she is on food stamps, how can she exceed the 125% poverty level requirement to support a visa?

We will be getting a sponsor, almost for sure, unless she will get lucky and get really good job :(

But it seems that we won't have troubles finding a sponsor.

Don't underestimate the ease of getting a sponsor...it's an incrediblly large favor to ask of someone.

Well during AOS interview people were asked about receiving means-tested benefits from state. Do not know what will happen if answer is yes. I guess it will make them scrutimnize your sponsor more. Also, i believe, they are more likely to suspect marriage fraud (poverty stricken citizens are more likely to do that). Since you are poor, may be its more logical to move to Slovakia??? Consider this. Cost of living there is much cheaper. But on the other hand no welfare.... (is there any ???). Teaching english by americans is pretty lucrative in Post Soviet territories. She only needs college degree.

Since you are poor, may be its more logical to move to Slovakia??? Consider this. Cost of living there is much cheaper. But on the other hand no welfare.... (is there any ???). Teaching english by americans is pretty lucrative in Post Soviet territories. She only needs college degree.

Well cost of living is cheaper but not that much and you can't even compare the wages here and in USA. But anyways, we don't want to move here, kids have their home there. And yes, even Slovakia has welfare :D

She has kids. If she needs to go on welfare, she needs to think of them before she thinks of her K1 petition and how foodstamps might affect it. Kids just come first.

However, aren't means-tested benefits for the USC still available? Especially since the K1 hasn't even been applied for?

Meaning...yes, down the road they'll probably have to have a co-sponsor, which they've already acknowledged they'll need, so for now, in this circumstance, it shouldn't do any harm for the USC to do this.

(I'm the immigrant so I'm not challenging what you've said, just trying to understand from what I've come to learn.)

well. Somewhere here, or on britishexpats one case was discussed. Despite having 2 co-sponsors, visa was denied at consulate, - means tested benefits for USC. So may be everything will be cool, but i would search more on that.

I just wanted to make sure you knew that you won't be able to work for well, anywhere from 3 to 6+ months when you first get here. You won't be able to contribute to the family's income so just bear that in mind...

01/17/2007 First touch of 2007 at CSC

01/20/2007 Touched AGAIN (also the 18th) come on...

February: Oops, RFE for a REGISTERED marriage certificate. Oops! Overnighted it.

02/28/2007 Paul gets email letting us know his GREENCARD is on it's way! It's done...for now!

03/09/2007 Paul's greencard arrives. And breathe...

We began with mailing the I-129 in on February 27, 2006 so the whole process took us approx. one year.

Well actually my POE will be JFK so I will request temporary 90 day work authorization. I know that maybe I will have to stop working for few days or weeks after this authorization will end before I get my EAD but it won't be for too long.

It's immaterial what effect getting foodstamps will have on your potential visa - she has children and looking after them has to come first - if getting food stamps will help keep them healthy, then go for it!
