I have another question: My kids got on their passports when we entered the US the same A# as me, only my 8 year old kids, my 18 year old son does not have that number written on his passport, should I take that same number to use on the forms? can someone help please? I wonder if anyone ever checks this forum anymore :) thanks!

Where do you see an A# on their passports? My wife entered with a K1 and her kids entered with K2's, and there's no A# on the visas or the I-94's.

Anyway, each alien is assigned a different alien number. Yours will be on the NOA2 approval notice for the petition. Your kids will have an alien number assigned to them when they apply for adjustment of status. At no time should two aliens ever use the same alien number.

The same # is behind the I-94 of our 3 passports, isn't that my A#? The one I should use on all the forms???

ok I just checked it and it is the same #, on NOA2 and behind my I-94. I will not use that one for the kids then. Thanks again :)

Should I have one folder for each of the kids and one for me or all documents of the same kind in groups? And therefore several cover pages or only one?

I got three manila envelopes, one for my wife and one for each of her kids. Inside each envelope was a complete set of documents, including a cover letter. I wrote on the outside of each envelope the name of the applicant and the type of application enclosed (adjustment of status). I put all three manila envelopes into one mailer. I didn't have any problems.

Hi everyone!

I got my package back :(

The kids needed to sign too, not only me as the person filling out the form, but them too, I understand that, my bad. What confuses me is that after asking me to correct and send back, the NOA says:

Based on the information you provided, your priority date could not be established. Please resubmit your application with the proper documentation to the address listed on the bottomo of this notice.

The following documents may be provided:

Your original form I-130, (Petition for Alien Relative) if you are filing concurrently; or

Your original form I-140, (Immigrant Petition for Alien Worker) if you are filing concurrently; or

Your original form I-360, (Petition for Ameriasian, Widow(er), or Special Immigrant) if you are filing concurrently; or

A copy of your Form I-797, (Notice of Action) if the I-130, I-140, I-360, or I-526 petition has already been filed/approved; or

Other evidence that an immigrant visa petition has been filed/approved on your behalf

I am not submitting any of those forms, only I-129F and then I-485. Can you please advise?

My step-kids were both over 18, so it seemed obvious to us that they needed to sign their own I-485's, but I know others have signed on behalf of their kids. As far as I know, somebody has to sign the "Applicant's Statement". Did you only sign as the person preparing the form?

Did you check box "c" in part 2 of the I-485?

If they're old enough to understand what they're signing then there shouldn't be a problem if they sign, but somebody has to sign the "Applicant's Statement". Without a signature there then there's no application.

Yes, I asked about box "c" because that box establishes that the application is being made based on an approved I-129F petition. There was another recent thread where someone got an RFE for the same thing. They checked box "c", and also included a copy of the I-129F approval notice. I have no idea why USCIS sent them an RFE in that case.

Would you remember who it was? I would like to ask what they did. I also included of course a copy of approved I-129F. Each of the forms lacking a signature has a NOA explaining the problem. Should I keep them all or returning them as they are just with the signature?

Am I correct that a K-2 who files for AOS prior to reaching the age of 21 will not "age out" even if USCIS does not approve her application before she turns 21 years of age? It seems to me that her age freezes on the date she files for AOS.

I entered the U.S. under a K-1 visa and have already gotten married to my fiance. Currently, I am in the process of completing the paperwork for AOS. I just have several questions regarding my kids (k2 visa holders) who have not yet entered the U.S. and I hope someone can shed some light.

1. Can I also file AOS for my kids even if they have not entered the U.S.? If so, which forms do I complete for them and what should I do about the signature portion?

2. Otherwise, is it enough to include them in the I-485 Part 3 (B) as 'Applying with you?' Are there other forms I have to complete or other documents I need to submit in this case?

If these questions have been raised and answered, please direct me to the proper link.

1.you cannot file for AOS for the children until they have entered the USA.

2. you would list all of your children, but you would check no for "applying with you". once they are in the USA, each child will need a separate AOS application.
