Complicated situation--help!

Hi,

We just applied with our I-129F. I'm worried about my special situation and if anyone has any advice or a similar experience.

I went to school in the US, and then applied for an artist visa (O-1) which was denied last December. My boyfriend (now fiance) came out that Christmas and asked me to marry him. We didn't know anything about the K-1 and since I was Canadian I figured I could just go back on a visitors visa. I tried that, and got flagged and interrogated for three hours, and against my better judgment, lied to the officer and denied that the person I was staying with was my boyfriend. They called him upon which he said he was my fiance, and I bet you can guess how that ended. After being printed, photographed, and questioned, ( I had already waited 6 months to see him) they sent me home convinced that I was going to work and live there with him and not just visit. The fact is, I WAS intending to only visit until we figure out how to go about the proper process. At the time, I was totally unaware of proving strong ties to Canada.

I'm worried because they brought up my denied O-1, and because I was sent back (although the record shows it was voluntary on my part). And worse yet, I was so traumatized by the whole thing, that I get really nervous just being in an airport now and I'm worried that will translate into making me look guilty for something later. I'm so scared that we will get denied again, and it will be my fault. Can anyone help me?? We've been apart for over a year now.

Did you sign any papers when you lied and were denied at the border? Is there anything written on your passport (some letters and numbers)? If not, you'll be fine. You got denied because they thought you wanted to stay, and now you are applying for a visa which allows that.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I was denied entry, I know how much it really stinks

The problem is, you'll have an exponentially more difficult time crossing now because you've been flagged as having immigrant intent and because you lied to the CO. A denail won't impact any K-1 or immigrant visa you have (unless you signed something or have something stamped in your passport...do you?)

The chances of getting denied entry again are strong, but not impossible. You'll have to show a RIDICULOUS amount of ties to Canada before you try and re-enter again (again, knowing from personal experience) because you'll be taken into secondary screening immediatly.

Nothing that should affect a K-1 visa but I doubt you will be able to visit while you wait. NEVER lie on any form or to any person in an interview.

Until she answers the question about signing anything or having some codes stamped in her passport, we don't know if her lie is on record. Being denied entry, in and of itself will not impact the process but a record of misrepresentation is a serious issue impacting US entry for a lifetime.

Facts are cheap...knowing how to use them is precious...

well, I did sign something, but I have copies of that. The officer is the one that told me to apply for a K-1, and what he told me was that the record shows that I withdrew my application for entry and not that they denied me. They did stamp my passport (which is now my old one, and yes I understand that they will still have a record of that). I'm worried about it for sure, but the officer assured me it would be ok...I just have no idea if he was just saying that? I was completely terrified the whole time and I'm sure I don't recall half of what they said to me. Does anyone have any experience with this? I also explained (on record) that the reason I was untruthful at first was because my lawyer advised me to not say I had a boyfriend/fiance in the US. The officer seemed genuinely trying to help me after we got through it all, but I have no idea....It felt like there was no law and I had no rights.... comments? help?

You still haven't said what was stamped in your passport. What is in that paper you signed exactly (obviously excluding personal info)?

Anyway, start the paperwork for the K1. :)

I read over it last night. Its a transcript, in which I DO state that my lawyer advised me to not tell them about my boyfriend, and also it says that I am not being deported, but rather withdrawing my application for admission. That is also what it says in my passport "application withdrawn". In the transcript it says "do you understand that for future visits to the US you will have to apply for the proper visa?"

I started on my K-1 paper work the day after I was returned to Canada, and I'm pretty sure its flawless! Of course, just our luck...we sent it Nov 30th, and they changed the fee amount nov 23rd, so we overpaid and it got sent back. The good news is it was sent back in 4 business days! It looks as though its been shuffled through too, so we're going to wait until my fiance comes to visit at Christmas and send it back then.
