Hi everyone,

I am a F1 holder and about to apply for green card. Hope to get some advice from you! Thanks in advance.

My main concern is that both me and my husband are attending gradue schools, so we are not living together currently. How should we justify this fact? For the application forms, should I fill my address using my husband's current adress (where we considered as 'home address')? Although I live in dorm now....

Do we need to submit evidence for marital relationship with I-130? Since we just got married, the transactions from our joint acct and credit card might not be very sufficient.....Hope to hear your suggestions!

Not living together won't look good to USCIS unless you have a GOOD explanation. You don't live with your husband so don't lie on the forms. If you have proof that you NORMALLY live there, make sure you include that in your packet. You might need to explain to them why you go to school so far away, why he didn't move with you etc etc

Yes, you need to include evidence of your relationship with the I-130. :guides: which will give you advice on what to include.

Also, when does your student visa expire? How long ago did you meet? how did you meet?

Thank you for your reply.

My husband is in military, so he is not very mobile, that is why he cannot move with me.

My student visa will expire next year Aug, and we met in 2007 while I visited US as a exchange student.

Do you think we would need to hire a attorney?And how do newly married couple provide tons of financial mingle evidence?

Another question is that I am a bit confused about the process. I consulted a lawyer before who said lots of evidence such as pics, bank account info, lease info will be needed for interview but not the initial filling. Is that true? Or do we need to prepare those supporting doc with the initial filling? I am just wondering how people would do that, let's say just get married for two months...there won't be many joint financial statement available...

Bear in mind also, the affidavit of support. You will have to prove making 125% above the poverty line for the I864, or you will need a co sponsor.

They are generally less strict on financial/comingling requirements for newlyweds, because they do know that it takes time to make this stuff joint. However, you do need to gather as much evidence as you can. If you read the I-130 instructions, it does suggest that you include some evidence of the bonafides of your marriage, but you can also bring new evidence to the interview (and should). The fact that you don't live together is something you will have to overcome, but it doesn't mean you will be denied. If you have a good reason, then you can explain it to them. I am not sure a lawyer will help in this regard.

There are several things you can make joint now, and present at an interview. Add each other to your car insurance policies. Take out small life insurance policies and put each other as beneficiary. Add each other to cell phone accounts, etc.
