Ok, I sent in my affidavit HOWEVER as of today things have changed!

My background, what I send in:

I make about $65,000 a year, have about $8,000 in the bank in savings, have about $22,000 in stocks and bonds and I am single(plus the fiance).

HOWEVER today I just found out that my brother never took me off his mortgage for his house and now its in foreclosure. I had no idea I was still on his paperwork, as it was a deal from a long time ago.

I am freaking out.....

My question is- will the government do a financial background check on me at any point after the initial papers sent from the NVC to the Embassy?

Should I quickly try to get a cosponsor and send the papers separately and hope that at the Interview they will accept them???

WIll my fiance be denied if they find out that I unknowingly didnt disclose having a property and now its in forecloser???

Will they do a credit check at some point? Do they just take the face value of what I stated on my affidavit? Do they just look at the paperwork I sent in, tax forms, pay stubs, stocks info, and bank statements?

I just dont want my fiance to go to the interview and they say, "We received the 134, and your US fiance was lying" She actually owes a foreclosed mortgage of $280,000.

Should I try to get a cosponsor to sign quickly and send off the paperwork for the interview?

you only need to make like 18k or so a year if it's just the two of you i believe. and debt has no effect on it one way or the other. they are only concerned with income (and assets if your income isn't enough) and you make more than enough. no worries.

though i would mention it to the fiance in case it is brought up for some other reason, better to show the two of you communicate fully.

Uuuhhh... It is my understanding that a background check is performed at some point. Not a credit check per se, but I think a foreclosure would show up. Whether that's a problem, I don't know. But you should disclose EVERYTHING to avoid problems.

An attorney recommended that I order a background check just to see if there is any erroneous info on it that the consulate could use to deny the petition. Financial entanglements, people living at your house, criminal convictions, etc.

Of course, the proper time to file your I134, including co sponsors, is at interview time, so its not too late if thats what you want to do.

Have a look at the I-134 and note that any disclosure of assets is optional, so just state and document your income. It doesn't say that but just trust me, they're optional if your income is enough. Unless you have an outstanding tax lien on your credit report it's just no issue at all.

As pushbrk noted, you are not required to disclose assets on the I-134. The purpose of the form is to determine if you meet the minimum requirements to sponsor an immigrant. If you meet those requirements based solely on your income then your assets are irrelevant.

Now, brass tacks...

I own my home. I didn't declare it on the I-134. I didn't need to. My income was enough to qualify. However, the consulate knew that I owned my home. They also knew that I owned a business, in addition to my full time job. How did they know this? Because they do background checks. Those checks include public records, such as property deeds and business licenses.

Will they know about the foreclosure? Perhaps. Will it make any difference? Not unless the CO thinks it will impose a financial burden so heavy that it will make it difficult for you to support the immigrant you're sponsoring. The likelihood of them making that conclusion because of a foreclosure is very small.

Don't worry about it. :thumbs:

Had the Interview today and they didn't ask any financial questions......all that worrying for nothing!!!
