Gonna send em a bill?

Well my dad is a personal friend of my local congressman, so he is going to go to his office with Sean.

One of the problems I am having is, no where during the K1 process did any of us know what the mysterious "medical forms" were called. They were all sealed in a super-secret envelope. Now I am being asked to produce these forms, and no where in any of the guides are these forms addressed specifically by number.

So how do I explain to the Congressman that I am certain that these forms were submitted, when I never saw them myself, don't have a copy, and can't find them specifically listed anywhere?

The forms I am being asked for are:

DS- 2053

DS- 3024

DS- 3026

Where are these in the guides? No where.

When do we see/use these forms? Never.

Why are we responsible for collecting these forms when they are not allowed in our possession at any time?

02.09.2007- Met online (EverQuest 2)

07.11.2008- Met in person (Orlando)

02.14.2009- Got engaged (Toronto)

Well... actually you should have seen the forms when you entered your personal info on them prior to the medical appointment, I know I did (as is the norm in Melbourne). Did I remember the form numbers? No.

The way to explain that you're CERTAIN these forms are submitted is:

1. I wouldn't have been given a K1 without a medical

2. I wouldn't have been permitted entry without the entire "brown envelope" that held the medical.

Myself I contacted the panel physician from my K1 and had him send me a copy of my medical. I explained the current issues and why I was requesting a copy BEFORE getting an RFE. He sent me a copy and I now have that copy in my immigration folder "just in case". Wasn't RFE'd for it luckily but I did have it.

I am seriously thinking once this is all said and done, we should try to start some sort of movement or organization to get someone in the government to step up and stop this sort of BS. Like I said, we were told by Officer Fox at the USCIS, The California Service Center is sending out this particular RFE to just about everyone coming through their office on a K1. She says she fields a question about this exact thing many times a week. This is SO wrong.

I guess that's true about filling in the identifying information prior to the medical. My husband is the Canadian, so I think he was sent these forms as part of his packet 3.

Anyway, the completed forms were never available for us to copy.

I did request a copy from the panel physician. The feedback I have gotten so far from the Canadian forums is that Dr. Seidon won't give copies. We'll see.

Unfortunately, the BP at the Lewiston Bridge where we crossed in New York thinks that they don't take the medical. I spoke to someone yesterday who researched my case and then called me back. He claims that K1 Visas do not require giving the medical to the BP. He said that only immigrant Visas have this requirement. I wonder why they took it from us if they thought it wasn't required . . .

So, I just heard from my congressman's office. He said that they emailed USCIS regarding the missing medical paperwork, as per their request. He said, they send an email asking about this, and USCIS responded, basically with a form letter never answering his question (what a surprise). He said he does and the name and number of the person responding in the email though, and will call them to push for an answer and a resolution. He says he should be able to call me tomorrow with some sort of news. He agreed that this is totally ridiculous though. I explained that if they INSIST that my husband has to do the medical again, THEY should pay for it.

Hopefully we will have some good news tomorrow.

Completely normal. They send the card, and THEN they send the approval notice, so it goes to the last step, then backwards to the second to last step. ;)

Completely normal. They send the card, and THEN they send the approval notice, so it goes to the last step, then backwards to the second to last step. ;)

USCIS are backwards :P I don't know whether they are coming or going !! :P

So, here is an update on this. The USCIS website shows that our letter addressed the RFE and they sent the whole thing back to the California Service Center for them to decide what to do, since it was their RFE. Our congressman's office has some contact there that is suppose to be coming up with some resolution. The congressman's office should be calling us today, or we will call them for an answer. In the meantime, the CSC will make some sort of decision and mail it back to us.

We are plugging along hoping for the best on this.

My husband and I have enlisted the help of our local congressman's office to help us with the medical RFE we received. This is paperwork the USCIS has, but either doesn't recognize it, or lost it. In any case, I got a call from my congressman's office (they don't have an immigration specialist there), who said his contact at the USCIS told him our case has been forwarded to the WFC. I have never heard of that, and he couldn't tell me what it meant. He is going to call them back and get more info and call us tomorrow. However, we were already told that our case had been forwarded to the CSC because they are the ones requesting this in the first place.

So tell me, you think he meant the CSC, or is there such a place as the WFC?

Hi,

We rec'd and RFE for the medical forms which were turned over in the sealed envelope at POE. We responded to the RFE with a letter explaining that they have the ppwk or my husband could have never come on a K1 visa last Dec. We were told by the USCIS that our case was turned over to the requesting office, the CSC. I am wondering if there is a time frame in which to expect a decision or can they just take as long as they want? I am hoping for a quick decision so we know what to do to get our case moving again, but knowing the USCIS, not expecting this.
