So, in Amsterdam, my husband got his medical and received his K1 visa, back in Dec.

Fast forward to Friday, when we received and RFE saying the USCIS has not received his DS-2053, DS-3024 or his DS-3026. He also went to a civil surgeon here to get the proper paperwork sent in. My question is HOW could he even receive his K1 if they didn't have all that in the first place? It was required before his consulate interview!

We called the USCIS and they told us to contact the consulate in Amsterdam to see if they could fax or email us the missing paperwork, and/or the doctor if they won't. I am concerned about the time frame it will take the consulate or doctor as we only have until Nov 14th to respond. I am also concerned that they won't send it for some reason.

Any ideas, suggestions or words of encouragement???

I'm sorry, this happens quite a bit. They've lost it or just can't see it (usually they just can't see it).

Your options are:

1. Ask your doctor from the K1 to email you a copy

2. Make an infopass appt and tell them the medical is in there

3. contact your senator/congressman and ask them to look into it

4. Pay for a new medical. Depending on your local CS this could be less than $200, could also be much more.

I would do them in the order I've listed personally. perhaps even 2 and 3 at the same time "just in case". You are correct that time is of the essence so you'll need to start on this ASAP.

The "medical supplement" is listed in the AOS instructions. Depending on whether your DS-3025 is marked "complete" or "incomplete" you may need to see a CS and get your vaccinations transcribed into an I-693.

So, we faxed the consulate in Amsterdam the RFE with a request for them to send us the paperwork. They faxed it back, asking John to call them right away as they sent everything, including all his of medicals to the USCIS and no longer have anything to give us! We are going to book an infopass appointment or just do a walk in. This is beyond frustrating! AND STUPID. I mean...DUH, THEY HAD TO HAVE HAD IT FOR HIM TO GET HIS K1 IN THE FIRST PLACE!!! GRRRRRRRRRRRRRRRRRR. We cannot afford another trip to a CS do get his medicals done again, due to THEIR lack of organization.

Don't contact the consulate, contact the panel physician where you got the medical done. the consulate forwarded your ENTIRE file to USCIS. Trust me when I say fighting them about it won't help. One couple (that i remember, there's been more but their thread was huge) just sent a letter saying that it's in their file and they were denied AOS and had to petition to re-open. It was a huge pain.

Contact the panel physician and if that doesn't work (some don't keep records) then worry about the infopass. Best option is the congressman/senator but I've heard that can take a while too so try the panel physician tomorrow and if that doesn't work start all the other options.

We originally faxed them because when we called the USCIS NO information center this is what they told us we needed to do. John called the consulate last night (well 2am our time) because on the paperwork they sent us they said to please call them asap, SEVERAL TIMES. So, he called. A woman with a curt attitude talked to him and told him that not only did they send everything to the USCIS already, but neither they, nor the doctor he went to will have any copies to send us, as they don't keep them. We are going to do the infopass appt first (maybe just do a walk in) and see where that gets us. We really don't want to spend possibly several hundreds of dollars more because of USCIS's f"up. This is stressing us out now. If that doesn't work, maybe a call to our congressman will...but if not, I guess we are screwed and have to spend even more money on the USCIS's incompetence.

A slightly interesting turn of events. I called the USCIS to see if we could possibly do a walk in since there were no infopass appointments available to us for the rest of the month. I explained the whole thing again to the girl that answered the phone, and told her...several times...I wanted to escalate the call. After about a 10 minute, going nowhere conversation with her, she said she was going to escalate the call (good idea! Wish I thought of that!!!). So an officer someone gets on...and I explain the whole sad story again...and how I don't think it is right that we should have to pay again to see a CS for their mistake. He puts me on hold for about 10 min. When he comes back, he says, "You are right. This is strange, You husband couldn't have even gotten into the country on a K1 visa without the medical. I can't understand why, when you called before, they told you to call the embassy, since that will get you nowhere and is a bit stupid." (WOW, REALLY???). Then he says, "They should have contacted the office sending the request (RFE) to find out why they did that, since they should have all the medical paperwork. I would tell you to disregard that, but I know you can't yet. They should get back to you via email within 3 days with an answer as I think this might be our fault." (YA THINK??). "If they don't contact you within the 3 days, call us back and we can find out what their response is."

I mean, REALLY??????? So, this could end up to be just a big, stupid mistake on the part of the USCIS (imagine that). I will keep ya informed.

FYI, the people who your congressman/senator contacts can actually physically get your file, AND they have the power to actually DO something rather than just spin their wheels. You will never, as an individual, have access to this level of customer service. Stop messing about with the peons and bring in the big guns.

I'm hoping that if I can persuade enough RFE'rs to my cause, they'll decide that they've had enough of individually responding to congressional inquiries on the subject and just fix their darned process! Also, I found that the congressional aides I spoke with, despite being immigration liaisons had never heard of these problems before - How are they supposed to represent me and my interests if they don't even KNOW when I'm having problems with the government??

FYI, the people who your congressman/senator contacts can actually physically get your file, AND they have the power to actually DO something rather than just spin their wheels. You will never, as an individual, have access to this level of customer service. Stop messing about with the peons and bring in the big guns.

Ok ok...lol. So I just contacted our congressman's office too. They are sending us a form to fill out, and says make sure to give them the deadline date we have so they can get right on the case. Sounded like this was not her first rodeo with this. Thanks for the push. Hopefully it will turn out to not be a huge issue...but we are ALL TOOOOO familiar with the USCIS's incompetence to think that realistically. OOO, I also just realized that this particular congressman is up for election in the next week or so...PERFECT TIMING! LOL

Good luck to us. I am off to our congressman's office today, to drop off our paperwork so hopefully they can look into our RFE and get it straightned out for us. The deadline of Nov 14th is getting closer and this is stressful enough. Has anyone had much success with having their congressperson get involved?

If you followed my other thread on this, which I cannot seem to find at the moment, we have received an RFE for the medical forms in the sealed envelope that the consulate gives you, that you hand over to the POE officers when you enter the US, in his case on a K1 Visa. We have called the USCIS and spoke to 5 different people now. The 1st officer we talked to there, after insisting my call was escalated, told us that he would contact the local office issuing the request, in this case the California center, and find out why they need these, as they already have them, and it must be some sort of mistake. He said to call them back if we didn't get an email in a few days.

So, I called back today and talked to a different officer, who told me this...Apparently the California center is sending out these RFE'S to basically everyone. She said she is getting calls on this exact thing several times a week. She also said we only need to send them a letter stating that the medical forms were in the sealed envelope turned over at POE and the date. THEN, we get an email from the California center stating that they need the medical forms to continue our case or else it will remain on hold or be canceled!

I went to my local congressman's office today to ask for his help too. I was told that they might be able to help us, but would have to check into it first. Our deadline is Nov 14th and we are slightly freaking out here. Has anyone had any success using a congressman to help with stuff like this?

I called and emailed the Civil Surgeon who gave us the medical for the K1 Visa., asking for a copy of the lost medical forms (in our case it is forms DS-2053, DS-3024, & DS-3026).

I also emailed the Consulate in Montreal asking if they kept a copy as part of the K1 Visa.

I also called the border office at the Lewiston Bridge in New York asking if they had proof of rfeceiving the medical and sending it. The man I spoke to told me he would "look into it." Yeah right.

The level 2 USCIS customer service rep, Officer Smith, actually asked me if I made copies of these forms! I told him that we are not allowed to even open the envelop to make copies!

This is frustrating and ridiculous.

Well their mistake is going to cost us $120 (which is a good price for the medical), plus time lost, plus frustration, plus postage, grrr!
