Hello,

I haven't gotten my US citizenship yet but my oath date is scheduled for Nov 7.

As a permanent resident I filed for I-130 for my husband and it's been approved and the case has been sent to Visa Center. Since I am a permanent resident a visa number is not automatically avalaible and we have to wait for his priority date to roll around. We can only apply for AOS once a visa number has been issued.

My husband is currently living here as a F1 student so it's not like he is out of the country. Once I get my naturalisation what are my next steps?

Thanks in advance for the help, just trying to be proactive

Once you get your naturalization certificate in your hand on Nov 7 call NVC and tell them that you have become US citizen. They will ask you to send your copy of naturalization certificate and will upgrade your visa category so you don't have to wait for visa number to become available. Good Luck.

** moved from "Adjustment of Status (Green Card) from Family Based Visas" to "Bringing Family Members of US Citizens to America" as this isn't an AOS from Family visas issue and the OP is going to be a USC soon **

Thanks Malvika.

So he won't need a Visa anymore? I can just go ahead an file AOS?

Does that mean I will be done with the VISA center?

no, that means that the process will speed up, you will not have to wait that long. the NVC will still contact you later to continue the process.

As soon as your visa category is upgraded, you won't be waiting on line like LPR and NVC will start asking for neccessary docs including AOS.

Ok guys, I don't mean to sound stupid but I am really confused.

I never understood in the 1st place why he needed a visa number since he is already in the states.

Also, why did Vanessa&Tony move my topic here as I will indeed be adjusting his status and I am not bringing him to the US, he is already here. ??

sorry,

your right, I didn't read correctly that he is legally here on a F1 visa. just advise the NVC that he will be adjusting here since you became a USC, once you have your naturalization certificate. then he will be able to AOS in country. and yes you will be done with the National Visa Center and he will have the interview at a local office.
