K-3 spouse visa at first

I have Pakistani passport and my wife is US citizen by birth, recently i got married in Pakistan, But i am working in Dubai, should we apply K-3 visa through Dubai(UAE) , or apply from pakistan?

Any one have experience like that? :help:

Your wife will file an I-130 for a CR-1. Since you work and reside in Dubai, you can interview at the embassy in Abu Dhabi. To avoid getting an RFE to show your legal status in the UAE, have your wife include copies of your documentation that you would have received from the UAE with the petition when she files it.

The K3 visa for all intents and purposes, doesn't exist even though it's still on the books. Lately, USCIS has been sending both I-130 (for CR-1) and I-129F (for K3) petitions together to the NVC together and the NVC administratively closes the I-129F, which only leaves the I-130 active.

September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Yes I agree with what Ryan H says. In your case, your spouse should file for CR-1 which actually saves you from a lot of hassle. As for the embassies, don't worry about them for now as USCIS first has to approve your petition. Prepare documents for the I-130 and go ahead and file the petition there in the U.S. Once the petition is approved and your case moves to NVC, that would be the time for you to worry about the embassies.

Hey my friend some body told me (You have to have been resident here for 6 months before you can file) in dubai....

is this right? i got my resident visa(UAE) before 1 month. So we cant put file? till 5months? :(

asad - the '6 month rule' applies to the USCitizen, The Petitioner, when the Petitioner files via 'Direct Consular Filing' (DCF) in Dubai.

If yer not the petitioner, then 'that somebody' is misleading you (perhaps on purpose?)

If not any 'DCF' - then usually the Petitioner, USCitizen, starts off by filing an I-130 petition to the lockbox in Chicago, via postal mail / courier delivery.

my wife applied Cr-1 from USA, now case in is NVC , but my wife living with me here in dubai and doing job.... so she will go with me an interview on Abu dhabi... so any problem if she is living with me? she applied from USA and came back she is still here for 4 months? please tell me about this....

No problem at all- in fact, it is a good proof of bonafide relationship and should make your interview easier. Make sure you bring proof of the two of you living together. The only issue would be the affidavit of support, as her foreign income doesn't count. Does she have a co-sponsor lined up or enough assets to sponsor you?

my wife applied and now case in NVC and i got RFE but problem is in while process me and my wife living together in UAE, we are doing job in dubai and my brother is law household member is filled i-864a , now i am scared about this..... they dont know we are living together in UAE if they ask an interview so what i will say to them? please tell me thank you

I am not sure I understand- what exactly was your RFE about? How could they not know you live together, what did she put for current address and employer? Why did the brother in law fill I-864A and not I-864, did he list your wife on his taxes?

my brother in law is in USA and he is doing job , and my wife with me and both have paid taxes last 3 year , so my wife just come before 4 months and she is still here..... my applied from USA and come back here , she left her job last year my brother is law is our household member sponsor

I really don;t think your brother in law is your household member unless your wife is dependant on him. Just because they are brother and sister and/or live in the same house does not mean they are household members for the purposes of the affidavit of support.

If you've been living together for 4 months, surely you have some proof of this? Bills, photos, letter from her job etc?
