Case process at NATIONAL BENEFITS CENTER?

Hi All,

I just received a .....Request for Evidence Response Review

On September 27, 2010, we received your response to our request for evidence. This case is being processed at our NATIONAL BENEFITS CENTER location. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer....etc.

Does it mean that they get what they want? or they still can ask for request for evidence?

& why the case transfer to National Benefits Center?

Please help?

As per your timeline, you are doing AOS after the beneficiary entered the U.S in K1 Fiance(e) visa. Correct?

Transfer of the case from the Service Center to NBC or Application Center can happen. Probably, they might need the interview with the petitioner and/or petitioners biometrics etc. So stay tuned.

If you have sent all the RFE checklist, you must be fine to it.

Thank you dear yes my husband applied to adjust his status after marriage, we send all the check list but they refuse the sponsor and requested to send another one and we did, but they ask for sponsor passport copy and the man he lost his PP, thats why i was affraid they will send a request for evidence again and the case will take more time

The reason to ask the passport copy is:

1) To verify the age of the co-sponsor (sponsor must be at least 18 years of age)

2) To verify the domicile of the co-sponsor

Did you send co-sponsor's any other documents to verify the above? If yes, there is no problem.

No, this is wrong. The reason to ask for the passport of of the co-sponsor is to prove his/her immigration status... (.ie US passport, US birth certificate, naturalization cert etc.) ...I think they need to be USCs but I can't remember and 864 makes me go blind... sorry...

The passport especially does not prove domicile... it has no address listed on it at all! Domicile is not the important thing.

To the OP, did you get an RFE for co-sponsor passport copy and you only sent a state ID and a copy of their SS card? Because if I am reading this right, they might just deny because you did not comply with their request correctly. Neither SS card nor state ID proves anything about a co-sponsor's status.

In the last two instances the term domicile applies to country of residence rather than the actual street address.

If the sponsor states that they are a US citizen then the biographic page of the passport will be proof of that claim. That is what the RFE is about. If the sponsor is an LPR then they would send a copy of their green card as proof.

they are in receipt of

the evidence that you submitted

in

request of

the letter submitted to you

to ask for

more evidence.

That's all it is.

IF the evidence that YOU submitted is ENOUGH to satisfy

THEIR REQUIREMENTS

then

yer done.

otherwise,

expect EITHER

another RFE or

a Denial.

Since you hve this receipt letter

I strongly suggest that you (or the USCitizen)

call in to USCIS, get a tier 2 Human (see http://www.dhs.gov/xabout/structure/gc_1221837986181.shtm#5 )

and inquire for status

from

a Tier 2 Human .

If you don't talk to Tier 2 Human,

IMO/E

yer wasting yer time

and

yer filing fees

and my tax-payer dollars.

Get a Tier 2 Human, quickly.

I can't believe I am even responding to this but...

My admitting that I wasn't sure about the requirement for co-sponsors immigration status (but still correctly indicating the purpose behind the request for passport copy is to show immigration status) is not as much "false information" as you stating that sending a state ID with address and DOB is good enough for the passport requirement for RFE.

Anh map - yes to your comment about domicile, however, Loto states that a state ID with an "address" is good enough for RFE, and I strongly disagree and it worries me that he might suggest that to someone and cause their petition to be denied. A state ID can be given to students and people with work visas. Furthermore, a passport can show that a person is a USC, yes, but they could be an ex-pat living abroad. A USC living abroad (with no more ties to the US) cannot be a co-sponsor, yes?

And Loto, you give out false information all the time... I saw you the other day suggesting to someone that they had a choice to go for K-3, not to mention another famous instance. I think you help a ton of people, and I am sure that VJ mods and members are grateful, but you also think you are always right and have a bit of a complex about how "right" you are. So I ask that you simply correct any error I may make instead of suggesting that I need to "stop" giving out "false" information, and I will do the same for you.
