Touch on I-129 and I-130

Hi

My husband Gary and I are awaiting his approval. Our NOA-1 for the I-130 was received on July 23rd 2010, and our NOA-1 for the I-129F was received on August 24th 2010. This is at the CSC. I noticed we got "touched" on both applications on August 30th 2010. I'm new to this forum, what may this mean? Does it simply mean that the cases have been pinned, or are we close to an approval even though it's only been 2 months? We have a very good Immigration lawyer and I'm REALLY hoping this all goes thru quickly. Any information is appreciated as my husband is living in England(he is a UK citizen) and I am living in our home in the US(I am a US citizen. This is all so hard and we just want to be together.

Lawyers dont speed up the process, they fill out your paperwork and mail it for you. Most people on this forum will say that lawyers actually have slowed the process down for them or even messed it up so badly that they had to start all over again.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Lawyers dont speed up the process, they fill out your paperwork and mail it for you. Most people on this forum will say that lawyers actually have slowed the process down for them or even messed it up so badly that they had to start all over again.

Correct If you have trouble because of previous visa filings or trouble with the law then lawyers are useful other than that they do end up slowing things down. Filing a K-3 when they have been administratively closed doesn't help.

k-3's were closed 2-2010

Thanks for the replys, so basically a K3 Visa means nothing anymore? The I129f forms seem to be going quickly in California. We are just crossing our fingers that this whole nightmare is over with quickly. We got a lawyer out of sheer panic. we went to England for our honeymoon and on return to the US my husband was denied access back into the country due to a past over stay on a visa waiver.

That touch might just have been your 129F being "paired up" with the I-130 you had sent earlier ...

and they do !

but

normally, when filed for the same person -

the two casefiles are given to the same adjudicator (who processes them seperately and independently)

and

they are sitting on the same desk.

when both are finished, the adjudicator sends them off, together, to NVC .

The purpose of a K3 was to allow a spouse of USC to enter the USA while awaiting approval of an I-130. Since I-130 and I-129F for the same person are essentially paired up, approved, and sent to NVC these days by USCIS, the NVC administratively closes the K3 leaving the only the I-130 for IR-1/CR-1 active.

The overstay could be an issue when it comes time for the embassy to review the application, it depends how long it was. This is where an attorney can probably be of help.

I have a question regarding the K3. My I130 was filed two month before I filed the K3. Would the K3 have any sort of an impact on the I130 like slow it down or anything?

So then, if the K3 means nothing any more, and the 2 forms are sent to NVC, what is the next procedure, and how much longer will we have to wait. I'll be very annoyed if our lawyer has screwed up here. In laymans terms, if he HAS screwed up, how much time has he lost us?
