what's the point of getting it approved on the same day if they know that somehow it will be administratively close at nvc? we thought before that we're gonna be on the CR1 path..coz what happen with our case is we sent our application both I-130 and I-129f at the same time.. and we only got the noa1 of I-130 and it was later after 5 motnhs when they sent us the noa1 of our I-129f dated aug. 18...and it's approved 12 days from noa1 date.. so i don't really know what to expect now..

DITTO!

And you are lucky to get the K3 closed .

Just a few reasons why to go with the CR-1. If you are eligible for a IR-1 then you would be nuts going with a K3!

The K3 has to adjust status which cost $1010 + $131 visas application fee.

Have to go thru the cost and hassles of getting a I-693 also.

K3 normally has to do biometrics and have a AOS interview. Time off from work cost the petitioner. PLUS the hassles of submitting the paperwork and going for the interview. Tain’t fun.. Especially if denied or questioned. Ever done a Stokes interview?

That’s the second interview if they are in doubt of your relationship.

Also a possibility of being deported. Yeah doesn’t happen much but it happens.

K3 has to wait about 90 days after they file to get EAD or GC so they can get SSN and be able to work.

CR-1 can work as soon as they get the GC and SS card in the mail. Normally with 6 weeks.

Can’t do a LOT of things without SSN. Like work or get a drivers license in some states.

Some K visas don’t get GC for a LONG time.

If petitioner goes belly up before you get GC you stand a chance of being deported.

If the petitioner loses his/her job after the interview you don’t have to worry about getting a co sponsor to adjust status!

CR-1 cost about $470

Get their GC and SS card in the mail within 6 weeks of arrival.

No biometrics , dealing with civil surgeons, AOS interviews, going to SSA for SS card.

I’m sure I’ve missed a few things.

Bottomline is anyone that goes with the K3 the way things are now are masochist!

Yeah I did but at that time K3s were a LOT faster. That’s not the case anymore.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

!! ALL PAU!

If they were both approved at the same time you should chose which to persue...The I130 will get you the green card in a shorter route as far as paperwork submission but may take a little longer...the 129f route takes a few more steps to end at the same result but is a little faster getting your loved one into the country, then you can be together while filing the rest of the paperwork.

We abandoned the I130 and went with the K3 so we could be together faster...she just got her green card yesterday...

Good luck to you

That is not true...

In our case I also received both NOA's at the same time, I then followed the guides for both routes, the I129f was faster so I abandoned the I130 application process and my wife came in on a k3 visa.

you should not comment if you have no idea what you are talking about...

Thank you

uhm - it is true, but it's 'date specific' as well - ie

any 'dual packet' received at NVC after 1 FEB 2010, sorry, the I-129F gets tossed.

Please review http://www.visajourney.com/news/2010/02/07/department-of-state-to-close-k-3-visas-if-i-129f-and-i-130-petitions-approved-and-received-together/ and Thanks in Advance !

Hey - Cool ! It worked out for you ! The thing that I notice, from yer timeline data, is that both casefiles arrived at NVC prior to 1 FEB 2010, so the I-129F was passed along from NVC to the US Embassy. Cool ! Congrats !

Unfortunately, for anyone having an NOA-2 approval date past 1 FEB 2010, the I-129F is tossed at NVC, when the two casefiles travel from USCIS into NVC, by NVC. See http://www.visajourney.com/news/2010/02/07/department-of-state-to-close-k-3-visas-if-i-129f-and-i-130-petitions-approved-and-received-together/ for a very detailed explanation.
