I-130 just got sent back

Hi VJers. I've been lurking here for a while soaking up the all the good information people have to offer. Now I need a bit of help!

I sent the I-130 on behalf of my wife in at the end of August and just got it back. The notice says:

"The application/petition has not been fully completed. One or more of the following field(s) were not completed:

- Part C Address"

The thing is, my wife's address is filled out properly in Part C. I'm not missing anything there or anything.

I noticed that someone drew a line down the right side of the page, and it ends rights beside Question 14 (If your relative is currently in the U.S., complete the following:" The person wrote either SS or && in the margin to the right of this question. I put "N/A" beside "he or she arrived as a:" because she isn't in the U.S. right now. Could that be what it is? Should I have just left if completely blank?

So, my question is, if it says "Part C Address", does it mean the address is wrong, or do they just mean something in Part C, not necessarily the address? And, should I have just left Question 14 blank instead of writing "N/A" there?

Also, if I call customer service, will they be able to tell me more about why the application was rejected, or will they probably just repeat back exactly what it says on the notice?

Any help would be so appreciated!

N/A for #14 is correct. I have filled out the same.

Are you sure #18 in Part C is correct?

"Address in the United States where your relative intends to live"

That would be your US address (assuming your wife intends to live with you :D )

Hope you didn't enter your wife's foreign address there...

I am looking at my copy of approved I-130 and as for question #2 the adress I put the complete address where my husband lives in Chile (quite long)

Question 13 I answered no and because it was no question #14 I left blank.

#18 where he is going to live in US (my address)

#19 where he resides at the moment (Chile)

Are you sure #18 in Part C is correct?

"Address in the United States where your relative intends to live"

That would be your US address (assuming your wife intends to live with you :D )

Hope you didn't enter your wife's foreign address there...

Then I looked down further and I noticed Question 21 "give last address at which you lived together." We've never lived together, so I have "We have not lived together yet" in there. That shouldn't be a problem, should it?

Question #21 is tricky I put the date I last visited him in Chile Example: I put 2/11/2010 to: 03/05/2010

If you did not visit N/A would have been fine

For #19, you would have included the country (Canada) in the address, correct? So it can't be that.

I am inclined to believe the problem is #21. Others have asked questions about #21 as well. I don't think you can leave it blank if you are married. Some folks have put down the address of the hotel where they honeymooned. Anywhere they stayed together, even if it was just overnight. I'm not sure what your specific situation was post-marriage. Haven't you two met and stayed together at all?

One of the things the USCIS looks at carefully is information to validate that the marriage is "real & valid", to weed out any abuse of the visa system. Is it possible at all for you to put down an address for #21?

Perhaps other experienced VJers could chime in as well...

Actually I retract the N/A answer there should be a date when you last spent time together, maybe wedding date...

If you search the topic of question #21 it seems like basically any answer works from all the recommendations of people who have all ready been processed.

I disagree though in theory that visiting and staying in a hotel is the same as living with someone. That though is just my un-USCIS opinion.

Thanks for all of the advice everyone. I think I'm going to call customer service and see if they can tell me what's wrong with it. Does anyone have any experience doing that? Can they actually give you a straight answer, or will they just repeat back exactly what the rejection notice says? I hear the operators are kind of useless... is there something I can say to get someone who can actually help me?

I just feel like without understanding what they think I did wrong, if I send it back with a couple of tweaks, I could get it right back again.

Oh and we definitely have met each other and everything. We grew up together in Canada. I moved to the US (I was born to Canada to American parents) when I was 18 and finally convinced her to marry me and move here. So, I've got all kinds of evidence that we really know each other, but we haven't ever actually lived together.

Also, has anyone who got a rejection ever seen notes in the margins of their forms like the "SS" or "&&" I saw? Does that mean anything?

Sorry... I'm asking a lot of questions at once here :-).

If you search the topic of question #21 it seems like basically any answer works from all the recommendations of people who have all ready been processed.

I agree, I put NONE as the answer to where we last lived together and had no issue at all. Visiting or staying a week in a hotel on your honeymoon does not constitute living together IMO.

There seem to have been quite a few RFEs lately regarding section "C". Hopefully filers that have resolved the problem will post their outcomes which will help others facing this dilemma.

How is it going? This happened to me. I can imagine how upset you are. THe operator was useless. However I emailed chicago lotbox support and received en email stating my petition was erronously returned to me. So, maybe you too are a victim. Just make sure the check is filled out correctly. You list yourself as the beneficiary's husband or family member. And try to contact support through email. I just sent mine in on the 13 and am waiting to hear if they acceppted mi petition. They havent cashed my check either so this si turning into a frustrating process!

I agree with you, but I stayed in his house that is why I put dates I last spent with him. I had no problems with it so I guess either answer is good. At least for me it stablished that I was physically there and also will be very beneficial to prove ongoing relationship.

Hello:

What about her foreign phone number. I looked at my I-130 and they ask for a phone number ( if any)????

I am not sure if there is no phone number listed if that will cause a delay or an return.

Just a thought????
