I-130 Information Missing??

C. Information about your alien relative (continued)

17. List husband/wife and all children of your relative.

In reading the various posts, on how people filled out the Form I-130, and what items are missing or what should have been answered; and comparing to my form, I realized on the above question, I (USC citizen)answered with my name but left off my children, which would be my husband's (beneficiary) stepchildren. :bonk::angry::blush:

My question is...should I worry about this, try to fix it (if possible), will this cause a RFE once I have to fill out the I-864? Any suggestions?

Technically, your husband's (beneficiary's) child(ren) has/have to be listed there. If no RFE, it is good. You can talk to USCIS live person and discuss it.

You would of written the childrens names if you were petitioning also for your husbands children "Your step children"

If you did not petition for them, no worries on a RFE.

Wait. Scratch my reply. YES list them on I-130 They have to be "declared" I hate that word.

Sorry, this is sometimes a trick question. Even if they are not your "blood" they are your husbands true children, you must include them on form.

Sorry, this is sometimes a trick question. Even if they are not your "blood" they are your husbands true children, you must include them on form.

Actually they are MY blood children, but my husband's stepchildren...soooo I guess your first answer was correct...

Oh geez, I mis-read, so sorry. Just glad you have your answer. But since they are his step children "No legal rights" you dont have to put them on the forms.

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
