This is almost as ridiculous as the laws in Texas!

Medical Marijuana Patient Faces Life in Prison for a Half Ounce in Texas

A Texas asthma sufferer who went to California for a medical marijuana recommendation and then got busted in June on a Texas highway with small amounts of marijuana and hashish is facing up to life in prison after being indicted by a Brown County grand jury. He is charged with possession of a controlled substance with intent to deliver, a first-degree felony in the Lone Star State.

Under Texas law, possession of less than two ounces of marijuana is a Class B misdemeanor punishable by up to six months in jail, while possession of hashish is either a state jail felony punishable by up to two years for less than a gram, or a second-class felony punishable by up to 20 years if less than four grams, although probation is also possible. It is unclear exactly how much hash Diaz had.

Diaz was pulled over for an expired license tag while en route from California to Austin, and according to the DPS trooper's report, could not produce a drivers' license or proof of insurance. He was then arrested for failure to identify, and during a subsequent search, police found a small amount of hashish on his person. A search of the vehicle then turned up more hash and marijuana in pill bottle from a California medical marijuana provider.

The DPS report said the search also turned up a cell phone "containing text messages referring to drug sales" and a notebook with "drug and law writings." Those are apparently the basis, legitimate or otherwise, for the drug distribution charge.

Texas does not have a medical marijuana law, and its authorities do not recognize having a recommendation from another state as a defense against prosecution.

Diaz has attracted supporters both inside Texas and nationally. The Texas Coalition for Compassionate Care and a group called I Am Sovereign are publicizing the case and pressuring Brown County officialdom. And the asthmatic Diaz sits in jail in Central Texas awaiting trial, without his medicine.

No sh*t. This guy is a joke. Asthma my azz!

I used to work with a kid that lived in CA around the Oakland area and he clued me in on the so-called "medical marijuana" farce. Just go to a friendly doctor and complain about headaches and leave with a medical marijuana card that lets you go to dope shops to buy dope. The local cops turn the other cheek, but it is still against federal law. So is illegal immigration, but we already know what a joke that is too.

Needless to say this is just another stupid liberal "cause" in which "civil rights" is is thrown around with reckless abandon. More fodder for the ignorant and gullible.

I don't buy it.

Not that this assclown should get 20 years for this lunacy, but washing police cars for several months or picking peas at the the county pea farm for a few months should teach this bozo a lesson. Along with a jailbird buzz haircut. ;)

Pot? Really? Pot? All you people (forgive me Empress) still want to pour on the hate for marijuana? This is where, if you ever decide to wonder, people start to question your real values and wonder if you're just about general scorn and intolerance.

I know nobody actually cares, but there are several smokable herbs that help with asthma: pleurisy root, lobelia, and sativas, to name a few.

Cannabis is something that grows in the ground. It's illegal because of some profoundly tricky maneuvers that went down some decades ago, but it's one of the most harmless altering compounds you can ingest and many states are working to recognize that, both because as an intoxicant it's incredibly safe, and because it has real, major benefits for a lot of people that are legitimately suffering.

Plenty of people take advantage of this renegotiation to enjoy its recreational effects, but I don't see that as worthy of such utter contempt. Have you ever had a G&T (forgive me Empress)? It's like that. And yeah, it's illegal. I suppose you also spit on jaywalkers.

Is it a reflex to hammer on anything that seems the purview of the dirty left? Because this is nonsense, gratuitous lazy hateful nonsense. These threads where a bunch of you stand around in a circle kicking dirt on people are so ugly. Is that the point? The simple pleasure of rejecting and insulting someone? If so, fifth grade called; it wants its social ethos back.

It was the Zig-Zag rolling papers the DPS found in his car that was mentioned in another news article that outed him.

But seriously...there are lots of legal medicines this guy could get through a legitimate prescription. Read my post above. This whole medical marijuana farce is just that...a farce. In the vast majority of cases where people claim they need to do weed for "medicinal purposes" there are numerous other effective alternative medicines that do not cause the intoxication that is the main reason these clowns falsely claim to be ill in the first place. Instead of aspirin for a headache they want to smoke dope instead. Ridiculous!

I still don't buy this joke in the vast majority of the cases. Maybe a small fraction of the dopers using this scam might be legitimate. The rest are just dopeheads that are making a liberal cause into some sort of retarded civil rights issue that just resonates with the usual suspects.

I could personally care less if the little guy wants to discretely grow a small amount of weed for personal use in the privacy of their own home. It is the profiteers I have the disdain for.

Lets just put it like this. If you have a serious pain-related illness and have the option between Vicadin and Oxycotin, or smoking weed, it is a proven fact that the weed is the healthier and less dangerous choice. However, for pain, Oxycotin and Vicadin are probably 100X more effective.
