I called in the day my 5 months was up (1/26/2011) and after being escalated to tier 2 they put in a service request and expedite request. They gave me a confirmation number and said I would hear back next Monday at the latest. It was approved that day and I received an e-mail this morning that there was no longer jurisdiction for my service request and expedite request because the file had been sent to NVC.

The tier 1 said they couldn't put in a service request. It's BS. Don't waste your time on them.

Did you guys get confirmation numbers if they sent in a service request? I just have a gut feeling they say they are doing something to get you to buzz off and then don't do squat.

Late 2006: began exchanging e-mails and IMs on and off

Around November, 2009: decided to meet in person

February, 2010: met in Thailand (first time)

May, 2010: met in Taiwan (second meeting)

August, 2010: got engaged

NOA1: August 26, 2010

November-December, 2010: met again in Taiwan (third meeting)

NOA2: 1/26/2011!

Yeah. You will most likely have to hold for quite some time. It's well worth it though, if you actually get through to the tier 2 rep. I work in a call center myself, so i know how the ques go. If you call and get a rep who doesn't want to escalate you, keep calling back until the que places you on the phone with a rep who is willing to help and escalate you. That's just how call center work. There might be a handful of people there who don't want to escalate you, but if you can finally reach the rep who will, you're in business.

Absolutely. Any rep who says they cannot escalate you is probably a new hire, or just plain doesn't feel like doing it. Or better yet, they're probably sticking to the company policy so tight, they're forgetting what it's all about...the customers.

Thanks for the replies! Yeah, I asked for my call to be escalated and they said there was no one higher up they could give it to. I knew it wasn't true. But wondered why they didn't. I'll keep trying then! And yes, I did get a confirmation number for my service request. If I explicitly say 'Could you please put me through to a tier 2 representative' will it get me better luck? Pretty much, the easiest way is to ask them something only a tier 2 can answer. The easiest is if your petition has been pulled and is on an adjucators desk, they will tell you they're not able to check that. You can then ask if they will escalate you to someone who would be able to, that should do the trick.

I feel a little dirty knowing how to work the call center :blush:

UPDATE:

After Nate's post, I figured I would log into the USCIS site and update to receive text updates.

AND....

The case had been touched... TODAY.

I click on the receipt number to look out of sheer curiosity and BAM! I-129F APPROVED! Mailed out today (yeah... okay :rofl: )

So the service calls actually work! For those getting close to or beyond their 5 month mark, CALL THEM!

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

Something to remember when you're calling: Every representative is different. Some will help, others are a sham.

If you're having difficulty with one particular tier 1... be polite and call right back 5 minutes later. Different representative this time.

Both times I had tier 1. Both times they were helpful and polite. The second time she was more than willing to file the service request and for some odd reason... it was already approved. She couldn't find this information but it was updated on the USCIS website in a about an hour after the service request. You got me on that one though... it's confusing.

Yes Kimo 3 is right. I called back twice on the same day. The second call the Tier one person said it was too early to enter a service request. I asked to speak to a level 2. They said I would get the same answer from them. I politely asked if they were refusing to let me speak to a level 2 manager. They said no but it would do no good. I agreed that they were probably right but asked again if they were refusing to let me talk to a second level manager and if so could they repeat their name and their employee number. They moved me to a level two manager who put in a service request and two days later I was approved. I had also called my congressman and both senators who checked on the case during this time as well. I have no idea if any or all of these routes worked in my favor but I did get approved and it was the only way I could be proactive after waiting patiently for 5 months! I hope this helps and I hope everyone gets approved soon!!!

Congrats!!! to all of your NOA2's...just wanted to share some updates since my NOA2 which was received on Jan. 13, 2011

So I waited for about a week before deciding to use the NVC automated system to track my USCIS Receipt Number. Starting on Jan.20 I called everyday, but everyday the same message. "I'm sorry we do not have any records of your case "or" we have not yet received your petition".

On Thurs. Jan.27 I decided to call NVC and waited forever to speak to an operator. When I finally got through the person asked for my USCIS Receipt Number, Name & Address of Benificiary & Petitioner and then gave me my case number and said it would be forwarded to Manila Embassy that week. On Saturday Jan.29 I received a letter in the mail from NVC dated Jan.26 that they received my petition and that it would be forwarded to the Manila embassy. I was so excited to receive a hard copy of the statement.

Today is Monday Jan.31 I just spoke to an NVC operator and according to them my Petition was received on Jan.24 and Forwarded to Manila Embassy on Jan.25...it seems that the dates they give don't match up, but I'm just glad it's moving. I guess I just have to wait until my fiance receives her packet of instructions or call Manila Embassy to check if they received it...

I'm just glad we've reached this point...anyone have any suggestions on next steps while waiting. she's been running around getting her Passport, DS Forms 156, 156K, 157, 158???, 160???, Birth Cert, NBI Clearance, Police Cert, Evidence of Meeting, Evidence of Engagement, CENOMAR, will send my I-134 Aff. of Support, Visa Photos, ...

when should she pay the K1 Visa Application Fee? Now or when she receives the instructions packet? and also the Medical exam? and CFO?

any comments suggestions would be greatly appreciated

The agent I was talking to was actually going to put in a service request but the system blocked him saying I had to wait another 9 business days which doesn't sound right as I called last Tuesday and was told to wait 10 business days :angry:

Just wanted to do a mini update. I received a hard copy of my NOA2 in the mail today, and i called the NVC number to check if they received my case, and i was surprised to hear that our case was forwarded to the Moscow embassy last friday. That was a lot quicker than i thought it would be. I guess i should start getting her prepared for the interview :)

Just wanted to let you know that our K1 has been approved, I received an email from USCIS a few hours ago!! :dance: The NOA2 should be in our mailbox in a few days. We have been approved 5 months exactly after NOA1, without any touch in between.
