hello,

I'm applying for a k3 visa this November. My question is I have a Injury to a child charge which i receive Deferred Adjudication probation.

This was back in 97', so I was wondering will this effect my k3 visa application in any way? I did 4 yrs probation. And no this did the result in a final conviction.

you may want to rethink that 'apply for k-3 visa' route...

You may be pegged for Biometrics whilst the I-130 is processing - if that's the case, expect an additional 4 months of casefile processing, before the I-130 is approved.

no, usually if a US Citizen (YOU) is convicted of a felony, or have any arrest that is VAWA-related, then a biometric intake is done on you, at yer local USCIS office - it's another level of -

--taking fingerprints

--taking yer photo

Are you still looking for a visa lawyer? You must understand, immigration attornies, whilst they MAY be members here, do not answer specific questions about particular casefiles in open forum or even via PM - as this type of activity flips them into an implied 'lawyer-client' relationship, and as such, is a violation of their code of ethics.

However, even with that said, you might (and should) check out ilw.com and aila.org , to find an attorney that specializes in immigration issues.

If you were 'told something', then by all means do some basic research, vette the opinion that you've received.

No, I'm not a lawyer, nor do I play one on TV. I am a big fan of Marc Ellis, though, an Immigration Attorney - should you google 'Marc Ellis Immigration' - you'll find his website, on the first page of the results set.

As darnell simplied.. CR1 is better... I have seen others that have had far more serious charges get approved with minimal delay... It wasnt your kid was it? dont need a domestic violence type of slant on the charge... they will look at your background and will likely mention it to her to see how well she knows you... shouldnt be much of an issue IMO.. but I'm no Denny Crane

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)
