My aunt's petition for my father's adjustment of status was approved in the year of 2005. At the time I was only 16 years old and we've been waiting for 5 years to wait for our instructions on what to do next. We finally were told to fill out our I-485 and other documents. We finally sent them out and now waiting 2 weeks and only my mother and father have gotten their new case numbers in their I-797c Notice of Action. I wasn't sent mine and am wondering why since we sent our applications together in one folder. I am 21 years old, but at the time when the application was approved I was still a 16 year old minor. I am just wondering if anyone has gone through something similar to this and has any advice. Please I really need your help.

because you aged out, probably you'll have to find an attorney who knows about the CSPA and if you qualify, not everyone does. was the priorty data current that they sent out their adjustment pacekt with the fine? please give us more details.

There was no priority date on the I-797c forms that my parents were sent out. Under priority date is blank.

EDIT: Shouldn't I be covered under the CSPA though since the only reason I aged out were because of delays of the USCIS.

You'll be covered under CSPA, but many times, you have to 'draw attention to that fact'.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

on the approved 1i30 in 2005 the priority date shows. it's usually a few days after the USCIS received the application.

** moved from "Adjustment of Status (Green Card) from Family Based Visas" to "Bringing Family Members of US Citizens to America" as the prior forum is for K1, K2, K3 & K4 visas so this is a more appropriate location**

To repeat -

you're gonna be 'grandfathered' under CSPA

But - sounds like it's slipped through the cracks - you need to research this, and make sure you are 'recognized' at USCIS as a CSPA-eligible person.
