hello,

i got my visa k1 and im married now before 90 days, but i didn't send my case to adjust my status (green card) before 90 days, so my question is:

CAN I SEND MY CASE NOW WITHOUT PROBLEM AND WAIT UNTIL I GET MY GREEN CARD OR IT'S ALREADY LATE FOR ME ?

THANK YOU.

As long as you got married within the 90 day window then you can submit your AOS petition. The general requirement that you have to maintain your non-immigrant status in order to adjust status does not apply to the spouse of a US citizen.

When your AOS petition is accepted by USCIS (when you get the NOA1 notice) then you will be granted a period of authorized stay; i.e., you will no longer be out of status. Until then, don't go near any place where you might encounter any US immigration officials. It's highly unlikely they would try to deport you, since you're eligible to adjust status, but they can still give you a rough time.

YES! With in 90 days of the date of your Arrival you have to get Married & Your Visa is Only 3 Months, but like you say you did Married before the Expired Date ,it means you have the reason to Stay but you have to File your F- I-485, As soon As Possible to live Legally and your Still in the time Frame of Filing, soon as you Filed and have them Recieved it , thier Response Paper to your application will be your Temporary Visa/Proof that you enter US Legally and your Papers are On Process, till the Processing get done & Have your Card. :star:

4 threads all asking the same thing over several days have been merged into one thread and duplicate post removed. It is not necessary to start a whole new thread to ask the same questions or to request further information about one of the answers. Keep all of the posts related to the same topic in one thread only, please.

“...Isn't it splendid to think of all the things there are to find out about? It just makes me feel glad to be alive--it's such an interesting world. It wouldn't be half so interesting if we knew all about everything, would it? There'd be no scope for imagination then, would there?”
