Got my NVC notice! They sent our package not to Kiev but to Paris!!

Hi dear helpers!! We got our NVC notice today! But I notice a big mistake! They sent our petition to the USA embassy but in France! In our petition it says very big that the interview should take place in Kiev!. My fiance is living in France, but when he went for his denied tourist visa, they told him, that he should be making any kind of visa in his home country... I am all confused. I will need to find out if we can really make visa interview there or what. I am clueless,,I have been reading all about embassy in Kiev, I know nothing about France. ok any advice? Thanks all!! I dont get it, why if its very clear in a question number 20 of the i-129f form that is in Kiev , Ukraine they make this error! Thanks all! :help:

I think the big question here is how did you answer question 20 on the I-129F, the one that pertains to which consulate the beneficiary will apply at? are you sure you put Kiev?

Contact NVC immediatly if a change in consulate is required. Also, call the consulate that the petition has been sent to have it returned to NVC to have it sent to the right consulate

Further, are you absolutly sure you cannot appy in Paris? Who told you that? I'd contact the consulate in Paris to be sure

HI Thanks!! I have the copy of our petition with me :) and I put Kiev, Ukraine on question 20 :) The thing is my fiance is Ukrainian national, living and working in France for around a year. He applied for tourist visa some months ago and went for interview in Paris. He was denied, and they told that if he want to proceed again and make another visa, he must try in Ukraine. I have many doubts now, I do not know if they mean just for tourist visas or if also applies for fiance Visa. I admit I got the notice one hour ago, and I need to research more about it. I am not against doing it in Paris. The fear I have is that we get there and they told, no you need to go to Ukraine we will send it back to NVC or USCIS. I will contact the consulate in asap. :)))

A similar thing happened to me.

I am a Swedish citizen living and working in Dublin.

When we filed the petition I put Stockholm, Sweden as the embassy I wanted to do the visa through.

They sent it to Dublin anyway. Maybe that's just how they do it?

Question 20 is a request - nothing more. Immediately below the question it says:

NOTE: (Designation of a U.S. embassy or consulate outside the country of your fiancé(e)'s last residence does not guarantee acceptance for processing by that foreign post. Acceptance is at the discretion of the designated embassy or consulate.)

They may have asked the embassy in Kiev if they wanted it, and Kiev said no. Maybe they didn't even bother to ask, and sent it to the embassy in the country where he was living. You could ask that it be transferred to Kiev, but there's no guarantee they'll do it. If they do, it will probably delay your case for a month or two - maybe more.

A K1 and a tourist visa are not the same thing. The embassy in Paris told him to apply for his tourist visa in Kiev because they thought he was "consulate shopping" - applying at a consulate in a country other than his home country because he thought he'd have a better chance of approval. If he has a valid reason for living in France, then there's no reason they should be suspicious of him for applying for his K1 visa at the embassy there. The choice of the Paris embassy was made by NVC.

Million thanks, I need to admit that I went a bit crazy. I went blind and did not read the note :bonk: Now I am way calmer. He is living in France until December so it can be even better to have our interview in Paris :)

Now we need to find out if there are big changes between Kiev and Paris what documents they ask for etc. Thank you!!
