same thing happened to me, I feel your pain

If you are past the 5 month mark, call USCIS and request to speak to a Tier 2 officer. You have every right to get an update. They can give you a better picture of what is happening to your case.

Do not rely on the USCIS blue circle status. My experience is that the Tier 1 person told me that I was still in review as I saw on the USCIS status page "blue circle". I asked and was transferred to a Tier 2 officer and was told that I was approved! As you can see by my signature, I am well into the NVC stage but checked my USCIS status the other day. It still says: under review!

Call USCIS! If the Tier 1 person won't transfer you, hang up and call again.

3/5/11- Paid IV bill

3/12/11- expedite to Bogota consulate approved!!!

3/14/11- left NVC to Bogota for further processing

3/17/11- received by Bogota, emailed consulate and was told to send DS-230 and DS-2100 (packet 3)

3/18/11- packet 3 emailed to Bogota consulate, email confirmation on March 23

3/31/11- Interview date! Approved!!!!!!

apeters, please call I know a lot of us would like to know what the heck is going on.I see some September filers getting their NOA2's and to me that is not fair..I can't call yet because my 5 month mark is December 28th...I wish approvals for us all coming soon...

Called USCIS yesterday, friendy enough but not much helpful information. I didnt ask for Tier 2 but they say that I was past 5 month and put in a queury. But the automatd message said to wait another 180 days. Then transferd to tier 1.

but on a good note my wife is here visiting and she had no issues with customs in LAX, asked her why she was coming and how log she was staying and that was it, didnt have to provide any proof of ties to australia.

Did she say that she was married? What info did she give them? My wife has come to visit me several times and she just doesn't mention the fact that she is married to a USC. Makes it so much easier. But my wife is from Canada and Canadians vist U.S. often. She is still nervous each time she crosses though.

Just realizing that my 5 month mark is January 4, I forgot I needed to count it from my NOA1 not the day I sent it off (DUH?). Honestly, this wait is just so......

Reading about August/September filers getting NOA2 just adds fuel to my fire. Nothing personal against them, but it is truly unfair! No more touches since we were transferred to this mysterious USCIS office. I check my file almost everyday hoping that maybe I didn't get an email notification and that there is some update made, but ya...wishful thinking on my part.

*kicks rock*

On the bright side, 11 more days until me and lil man go to visit hubby. I'm excited for a few weeks of quality time. Nervous about traveling as I always am, my last few travels have been hassle free so hoping this will go just as smooth. I'm looking out the window watching the snow fall and Miami is just what the doctor ordered!!

Just an update to my post, NVC received my details on Monday 6th Dec 2010, same day I received snail mail confirmation of my NOA2.

Today I received two email, one for Choice of agent via email and other for payment of $88 for Affidavit of Support electronically

In the emails, they will list your NVC Case number LND2010nnnnnn and your Invoice ID nnnnnnnn that you need.

The emails came 4 days after they entered my details into their system, I did call their number approx 3 times a day since Monday and until yesterday the message did not even acknowledge that they had my file, then last night the message changed to

NVC Assigns a Case#:

"...This case was entered in the NVC computer system on 6 Dec 2010. The case number assigned by the NVC is LND2010nnnnnn. Please allow 6-8 week from this date for the beneficiary to receive the documents"

Then this morning we got the two emails listed above.

Just got a nice surprise in the mail box today, my original NOA1 receipt date was June 25, Priority date June 14 and NOA2 notice date Nov 30. My file was not transfered out of CSC to Tx as some were.

Called NVC on 603 334 0700

option 2 - Non Hati

option 1 - English

option 5 - Speak to an operator

Spent approx 10 minutes on hold, was advised that my file had just got there today. Forgot to ask for my case number and had to call back and must have waited over 15 minutes the next time.

Was advised that the costs would be $88 for Affidavit of support and $404 for Alien Registration visa

Was advised that I could visit their website at immigrantvisas.state.gov to read up on the process.

Was told that as they have the email addresses from me and my wife (which they took during the call) they would send everything via email and not snail mail.

Next step was that they would send out two forms and if I had sent the forms in already to USCIS they could not accept then as they would need me to complete their forms which are different.

Forms are Choice of Agent which had to be filled in by my wife (we already did this) and Affidavit Of Support (I was advised the forma would take 2 to 4 weeks to generate).

When I asked for time frame I was looking at, I was told they do not have a time they can give me, I then asked what the average was and was told that they do not issue any time guide lines. I then asked them to log a complaint as they could add all the times of all applicants then divide by the number of applicants or do as USCIS did and give me a date that they would process the application in.

U r right, I read August/September filers page yesterday, it is unfair , some people gets their approval less than 3 months and others wait 4 or 5 months till now and who's know? till when we will waitting maybe 6 or 7..and wait 4 NVC the Consular interview, there is countries between me and my husband, its long distance..plz if any one call the USCIS to tell us what's going on...My five months wil end on 24 Dec, two weeks remainingwhistling.gif

I think in my case, my 5 months passed and approx 5 days later my file was touched and approx 7 days after the touch I got the NOA2 and called NVC to have them confirm that they had also received my documentation.

I do understand your frustration, but thats life I guess. I know I did not feel like that when i was in the same situation, my file to that date had not even had a touch, as crazy as that sounds, just plan for a delay of a couple of weeks after the 5 month mark and hopefully your time should be up. I hope I could have given you some better advise and not the bitter pill.

Just wanna ask this, was your file was also transferred at TCS on the first of Nov them on a localUSCIS office before you were approved? Im just bothered with the 180 days of waiting from the time of transfer. Hope its not true and you're on of us just to make my feeling now lighter.

Hi cutiezoe,

No I was dealt with by the CSC office throughout, I was however told that when my 5 months were up I had to wait an additional 16 days prior to being passed over to tier 2, that was in order to see why the case was taking so long.

I got my citizenship through the Houston branch and know them to be efficient - at least for me, I'm not sure if thats the Tx office thats being used.

I think that the California Service Center was going to fail their 5 month service pledge on many July cases so a decision was made to ship out the cases to another area, allowing them to catch up on other cases, its really sad that July applications are getting passed by, maybe we need to get everyone who is stuck in limbo to email their senator and get all those files moving.

I know how you feel as i was there a couple of weeks ago, but no where in the same 180 day ball park, that would have got me mad.mad.gif

I don't think I would put up with an additional 180 days after my 5 months though, why not also contact your senator helpsmilie.gif via email and have them additionally chase up your case, you don't have anything to loose and the extra pressure on the USCIS may make them process your case quicker, as they now have someone to answer to and that they have also failed to meet their 5 month goals.
