K1 Procedure

Timeline

Before reading my question I hope you all understand that I have read the "procedures" many of times, so please don't reply to me by telling me to go look at the procedure. I want to direct this question to experienced people here that knows exactly what's happening. :)

I've received my NOA2 last week. I know I'm supposed to fill out the I-342 or for sponsors. My question is my Fiance (the beneficiary) supposed to get notice too? Is he supposed to get notice from the Service Center? Or his embassy? [he is according to the NOA2] right?

My problem is that we didn't realize his location (Edmonton Alberta) was suppose to put Vancouver Amer. Embassy on the I-129; so we put Calgary! So, at this point, how do we know if it's Vancouver or Montreal? Is he supposed to get something from the Embassy before we take action?

Any replies would be of help. -Thx

The foreign fiance will be contacted by the Consulate after the case clears NVC. NVC knows where to send the case file. There is only one US Embassy in Canada, and it's in Ottawa. Montreal and Vancouver are Consulates. An Edmonton resident's case file for a K visa should be sent to Vancouver no matter which consulate you listed on the petition. If not, you can request it be transferred.

The foreign fiance will be contacted by the Consulate after the case clears NVC. NVC knows where to send the case file. There is only one US Embassy in Canada, and it's in Ottawa. Do you know how he finds out when he will take his medical examination and interview? Hopefully it's on the same day? It wouldn't make sense for him to fly to Vancouver twice right? We are very confused.

And another question I'm not sure if anyone can help. I forgot to ask. He needs to finish 1 more semester of school which will be until December before he qualify to apply for grad school over here. Since I got NOA2 so soon, how can he stay there to finish fall semester? Or does he have to come marry me right away? We are very worried about this issue.

The NVC is the next halt after the service center approves your petition.So you can wait for a week and start calling them (you could just search for their number on here),and yes please do speak to a Human.Not to the automated voice response system.They will let you know the new case number and also let you know when they sent it to your fiance's consulate.

Then the consulate sends your fiance a packet 3.You need to fill some forms and send them back.Actually,from here onwards it would be better if you asked all your questions in the Canada regional forum,they are much better equipped since all consulates are different.

And only then you find out about your interview and medical.

I found the NVC number 603 334-0700 ,try this !

Also regarding your fiance's grad school stuff.All I understand is you will have to use your K-1 visa within 6 months of getting it.

So if December falls within that range then you will be safe.Once you use the visa to enter the states, then you have to marry within 90 days.So you can plan it out well,since from what I have heard Canada takes a while to log packet 3s and then assign interview dates.

He should not take the medical and interview on the same day, he will need to bring the results of the medical to the interview (Yes, it will be in Vancouver)

He must choose one of the 4 doctors in Canada (one in Vancouver, one in Toronto and 2 in Montreal) to do his medical. He can do his medical once he recieves packet 3 which will arrive in the mail.

Once the visa is issued, he has 6 months to use it and then 90 days after entering to marry you. He cannot travel to Canada and return to the US without his advanced parole document. If I were you, I'd delay the process a bit (not send back packet 3 for a few months) to ensure he has time to finish school.

I suggest more reading of the Guides since the form is I-134.

There are other forms also. Finally check out your specific Embassy's website for specific requirements to that country.
