Co-sponsor or Household member?

Hello,

I'm filling out the paperwork for AOS and have a question about the I-864. I am the sponsor (my fiancé is the immigrant, right now he has a K-1 visa). I'm currently a student and substitute teaching, so my income is not enough. My mother was a co-sponsor for the K-1 visa, but I'm wondering what her status should be now. Should she be a co-sponsor and fill out the I-864, or should she fill out the I-864A Contract Between Sponsor and Household Member. (We are currently living with her). Are there reasons we should do the I-864 or the I-864A? Any help would be greatly appreciated!

Since you are all in the same house, she is a household member and she fills out an I-864A, and her income is put in with the household income (24b), and she'll add to the household size (on line 21g).

If she is living with you (has the same address as you as indicated on the W2 and income tax return), then you must fill out I-864A.

understand, of course, that you will also fill out your own 864, regardless what your co-sponsor fills out.

Remember, the USC petitioner will file a I-864 regardless of income. If your joint sponsor lives in the same household as the petitioner, then they will use I-864A. If they live in a separate residence, then they will fill in another I-864.

For your joint sponsor you will need proof of their citizenship/residency. For household member, you will need proof of relationship and same household/residence.

Proof of same residence -- tax returns with address, utility bills, letters addressed to both at the same address, driver's license showing same address--whatever.

Proof of relationship -- birth certificate.

personally I think a copy of drivers licences showing same address and a birth certificate showing her as your parent should suffice.
