F-1 Student 2010 Filers

We all know there is no clear guidance or regulation from the USCIS regarding whether a student is still under F-1 status if he/she has applied for I-485 adjustment of status. Since a student visa doesn't allow "dual intent" as in H or L visas, it seems that filing a green card application - a clear indication of immigrant intent..................

I would please like all F-1 student who has applied for I-485 adjustment of status to post their timelines, RFEs, and any other relevant information about their case. Posting these info will help us and all the future filers. Thank you

Hi , you can see my husband's timeline. He entered as an F1 about four and a half years before we were married.

I-485 sent in September 2006, concurrently with I-765 (work permit) and advanced parole

work permit granted in early January 2007, advanced parole arrived around the same time

No RFEs were issued

Interviewed in December 2006

AOS granted in July 2007

Lifted Conditions in 2009: applied in March, 10 year card received in June 2009

I just filed for AOS from F-1 due to marriage to a USC.

Applied with I-485, I-130 and I-131. No EAD filed yet.

I just received my NOA1's for all 3 forms today (April 12).

Hi all, did any of you work while you were waiting for your AOS using your EAD through OPT?

I was wondering if anybody has a similar situation as mine.

I was admitted as an F1 but 1 year before my I-20 and Visa expired I fell out of status.

I also worked unauthorized for a year.

Its 2 years later and I'm married to a US citizen and we filed to adjust my status.

I've been reading on most of these forums that unauthorized work/being out of status is forgiven if AOS is due to marriage to a USC, but has anybody on this forum actually BEEN in this situation?

If so what was your AOS interview like?

Did the interviewing officer even mention the previous F1 violation?/unauthorized work?

Well, a friend of mine was in same situation. He was asked about the F-1 violations/unauthorized work. Just prepare well with good reasons why you were out of status. Good luck.

I filed for AOS 2 months before my F-1 status expired. When you file for AOS you lose your F-1 and become, well AOS. I also have a few friends who got picked by the GC lottery while they were on F-1 and they adjusted during the time. They are still students, but PRs now.

Yes, OPT EAD was used until it expired (12/31) and then there was a short few days where my husband couldn't work until he received his new EAD from the AOS application. Timing is key here.

If you file for the EAD while on F-1, can you do work that isn't OPT? As in, if I'm studying exercise science can I go off campus and work as a bank teller or something if i get approved for the EAD?

I didn't bother sending in the EAD application with my packet cos I was under the impression I could only do OPT work, but if that's not the case I may have to send off the application.

OPT work means it has to be related to your field of study because OPT is considered a part of the F1 student visa. Therefore, you cannot work in McDonalds or in the mall.

With an EAD, you are free to work anywhere you want.
