Sachinky - quick question about the different visa types. So the F1 visa is for student visa to study in the US? I have a college friend that is marrying a japanese girl that is currently holding an HB1 visa. She has been here on an F1 visa and then work here on HB1 visa. She has been here approximately 10 years now. They are marrying here in the us. Does she have to move back to japan once she's applying for her green card?

Hey, yeah a F-1 is a student visa. H-1B is an employment visa. No, she doesn't need to move back. She can just adjust her status from that H-1 to that of a LPR.

I have a question. My husband is filling up a new I-864 according to the two jobs that is now working that will be submitted for the interview. His projected current annual individual income is $21,620. We can also show assets about $4000. Do we still need to worry about the joint sponsor 'cause my cousin is being absolutely uncooperative so far.

According to the Dept of Health and Human services website, the poverty threshold for 2009 - for a 2 person household is

$14,570

x 125% required (correct?)

$18,212.50 is what I come up with for adequate income to meet the requirements. I think you're ok sachi especially with the added assets.

Tatyana--I really, really hope you get a May interview. To get that, you'd have to have a case complete by April 9th, which is a few days off from the current timeframe (8-9 days). You'd have to be done in 7 days from when NVC received your RFE response. Which is NOT impossible and can very well happen, and I've seen a few RFEs being processed in 5-6 days but I wouldn't set my heart on it if I were you. Mentally prepare for a June interview, and if you get a May date, then, hey! that'd be great!

I am so upset this morning, I woke up to hear we have reviewed your case and found missing information. I called and Both my sons case and mine have RFE's. They are saying I didn't send Photo's with my sons case which I have the email, I know I did and They are requesting "Court Records". I willl official be leaving the april thread as I am not back in Canada till the ending of april , there goes the hope for a June interview. -crys-

Sachi, was that $4000 total? Don't they take your assets and divide them by 3? Either way, I think you're fine. The limit for 2 is $18,212 and he clears that without adding the assets. Are you still able to have his dad's info as a backup?

I've just spoken to TWO operators who were both fairly unhelpful. The first one refused to give me any information related to the application because she tried to tell me my wifes DoB was incorrect. This has never been an issue on any of my other calls to the NVC. The second operator told me to ignore the message on the AVR as they've recieved mail, but we have sent nothing but the AOS packet which they recieved on the 19th, and then the IV packet which they recieved on the 25th.

I'm not sure if I should do as the second operator said and ignore the AVR message, or call back a third time to speak to someone different.

Call & bypass operators & speak to a supervisor.
